Licensing Program Analyst (LPA) Mireya García arrived unannounced at the facility for the purpose of conducting a follow up complaint investigation to deliver findings regarding the allegations listed above. Due to COVID- 19 precautionary measures were taken, licensing staff present during inspection wore appropriate personal protective equipment. LPA met with Director, Victoria Garcia who guided LPA on a tour of the facility. There were thirty-six (36) children observed to be present at the facility during this inspection.

Information provided by the complainant alleges that child was injured while in care, staff did not seek medical attention for child's injuries, staff did not inform child's authorized representative of child's injuries, and child's hygiene needs were not met while in care.

During this investigation, LPAs Garcia and Green obtained a copy of Children’s roster dated 10/06/21, obtained a copy of the facility security video footage dated 09/29/2021 and conducted interviews with Director, three (3) day care staff, three (3) former day care parents, four (4) current day care parents and attempted to interview one (1) former staff.

Pertaining to the allegation of child was injured while in care, interviews conducted with Staff determined an incident occurred in September where child #1 was injured while in care. Statements from staff confirm that incident took place at the facility. Staff providing care and supervision disclosed not observing child #1 when child #1 was injured, child #1 was left without visual observation, this poses a potential health and safety risk to children in care.

Based on observations made on 10/06/2021, LPA García and Green observed facility security video footage of incident dated 09/29/2021, LPAs observed child #1’s Thumb stuck in between gate opening when staff #1 closed gate. Although staff was observed to be present, staff #1, staff #2 and staff#3 did not witness incident occurring since all staff were looking elsewhere. After a few seconds sometime under one-minute, staff #3 noticed child #1 was injured and provided assistance.

Regarding to the allegation of staff did not seek medical attention for child’s injuries. Interview with Director reveal child #1 was given a popsicle that was placed in child’s injury. Interviews conducted with staff confirm child #1 was given a popsicle to place on injury. In addition, when Director was asked about the facilities first aid supplies such as cold compress availability, Director informed LPAs that the facility uses popsicles and ice when administrating first aid cold compressions.

Based on observations made on 10/06/2021, LPA García observed one (1) box of popsicles stored in the classroom’s refrigerator (picture was taken). No first aid cold compress was observed to be readily available.

Referring to the allegation of staff did not inform child's authorized representative of child's injuries interviews conducted with day care staff revealed that an incident occurred at the facility where child #1 was injured and staff did not contact parent to report child’s injury.

Lastly regarding the allegation of child's hygiene needs were not met while in care. Interview with day care staff #2 revealed that staff overlooked area and did not clean child #1’s chin thoroughly after lunch which resulted in child #1 skin to be irritated from spaghetti sauce left on child.

Based on LPAs interviews which were conducted, and record reviews, the preponderance of evidence standard has been met, therefore the above allegations are found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, the following deficiencies are being cited (see attached 9099D).

A notice of site visit was given and must remain posted for 30 days.

Director will submit the training agenda, materials and staff sign in attendance for the training conducted to CCLD via email to LPA Garcia by or before 12/31/21 in order to clear this citation.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.
