An unannounced inspection was conducted by Licensing Program Analysts (LPA’s) Roxana Lopez and Saul Valenzuela on 09/18/2024. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 07/24/2024. LPAs met with Assistant Cynthia Avellaneda to whom the purpose of the inspection was announced. Census was taken. Licensee, Gerardo (Alex) Guillen arrived at 12:50 pm.

Throughout the course of the investigation, interviews were conducted with staff, children and parents. LPA also reviewed and obtained copies of children’s rosters and other documentations.

Per initial complaint report, the complainant reported that they were informed that Staff # 2 takes children outdoors, leaves them unsupervised while Staff # 2 goes back inside and the older children hit the younger children. Additionally, complainant stated staff # 2 has been observed caring for more than 14 children alone. --------------------------------------------------------- Pg. 1 of 2 -----------------------------------------------------------

In regards to allegation # 1 Staff left day-care children without supervision and # 2 Licensee operated beyond the terms of the license.

LPA conducted interviews with staff # 1- 2. All staff statements corroborated that when children are taken outside there is always 2 adults outside. In the event that there is only 1 adult present and adult has to step inside- they do only a short period of time, to check on food or get water. Additionally, staff # 1-2 corroborated that they are always in ratio as they have 3 adults present. If school pick-ups occur Staff # 1 will take children with them to maintain ratio in the facility if needed.

LPA’s conducted interviews with parents. Parent # 1 disclosed that they have observed Staff # 2 with “a lot” of children but was not sure if it was more than 8 children- additionally their child has informed them that they have been left outside unsupervised. Other parent’s statements corroborated that they do not have any concerns with supervision and have not observed the facility being out of ratio.

LPA’s conducted interviews with children. Children’s statements corroborated that there are always 2 adults outside and if Staff # 2 is the only one present- they only go inside for a little bit “to check the food or for water." Per child # 3 older children "fake hit" the younger children but were not able to provide details. No other children disclosed any hitting. LPA’s did not observed the facility to be out ratio during the inspections conducted.

This agency has investigated the complaint alleging Staff left day-care children without supervision and Licensee operated beyond the terms of the license. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.
A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Gerardo (Alex) Guillen.
