Per Interview with parent, her child has been in care for four months and it was stated that the child has cried off and on during the entire time. The child was out sick for a week from the day care and when the child return to the day care the child cried again for a couple of days and the licensee told the parent that she was giving the parent a two week notice to find another day care because she could not train the child to sleep and the child is disrupting the day care schedule and the other children in care. Parent stated she did not think the licensee should expect her child to wake up and sleep at the same time every day. Parent stated the licensee would tell her she has a routine for the children. Mom stated her child does not have a crying problem. Mom stated yes she signed the contract that stated the termination policy of written notice from the licensee if termination is needed, and a two week notice would be given but does not think that is a reason to terminate the child.
Per Interview with the licensee, it was stated that yes she does try to have a routine, a schedule for all the children and she teaches them to be independent. Licensee stated she tried to help the child since the child started four months ago and the child continues to cry. The child would cry when dropped off at the day care and cry when playing, he would get frustrated and wanted the other children's toys they were playing with and when going down for nap hearing the music and waking up from nap, he would cry and only sleep for a little bit and would wake up crying. Licensee stated her and the parent had communication about the child and the crying all the time and mom even asked for the licensee to give the child his comfort pillow that he was using since he was smaller. Mom was aware of her child's crying and licensee said she did everything she can to help the child and gave mom a 2 week notice. Licensee states she only called the mom one time on 03/03/22 to pick up the child because of crying and mom never came to get him until the regular pick up time.
Based on the available information, and although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated
The Notice of Site Visit (LIC 9213) was given and must remain posted for 30 days.
