At 9:20 am Licensing Program Analyst (LPAs) Roxana Lopez and Staicy Perry conducted an unannounced required 1 year inspection to the above facility. A COVID risk assessment was conducted upon entry. LPA met with Gladys Ornelas, Licensee’s daughter who stated Licensee was not home. As LPA’s were leaving Licensee Guadalupe Ornelas arrived and took over the inspection, guiding LPA’s on a tour of the facility. Per Licensee, there are 7 children that are currently enrolled. A current children’s roster was available for review. Licensee, arrived with 2 children 1 being an infant.

The licensee states that 3 adults currently live in the home. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed child care home.

This is a one- story home which consists of 4 bedrooms, 2 bathrooms, living room, kitchen- dining room garage and backyard (fenced- divided in two). The children have access to living room, kitchen-dining room, 1 bathroom, 1 bedroom and front part of backyard.

Per licensee, areas off limits to children and parents include 3 bedrooms, 1 bathroom, garage and back part of the yard. The LPAs toured all areas used by children during this visit.

All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness.

There is telephone service via a cellphone that stays at the facility during operation hours. There is ventilation and heating (central). The following was observed and reviewed during this inspection.

At 9:35 am LPA's observed the home to not be oderly- food particles were observed on the floors throughout the house, plates of unfinished food left on the tables. The bedroom designated for use of children had various items of clothing on the floor- there was also power tools on the floor accessible to the children. Poisons were accessible to the children in the living room, bathroom, bedroom and garage(unlocked). LPA’s advised that all poisons should be locked under key or combination lock. Poisons were removed during inspection. Off-limits areas were observed not to be locked and were accessible to the children. LPA observed various swords and bows and arrows in an unlocked bedroom. LPA’s advised that all off limits areas should remained lock during day care hours.

At 9:47 am The outdoor area was observed with debris- animal droppings throughout the yard. Play structure was observed to be full of cobwebs- a kiddy pool was observed with dirty water and a dog water dispenser was filled to the top of the rim and had a constant flow of water going. LPA's also observed a bird habitat with various birds, habitat had openings big enough to fit a child's finger through them. LPAs advised licensee that kiddy pool should be emptied out, dog water dispenser should be emptied and a mesh should be placed around the bird habitat to keep children safe in the backyard. Per Licensee, children are not allowed in the backyard at this time and will not be allowed until it’s cleaned. Child # 1 disclosed playing in the back yard.

At 9:50 am The valve on the required 2A 10BC fire extinguisher was last serviced on 6/25/2021, as indicated on service tag. Per Licensee, they have one that has never been used- and was informed that it did not need to serviced. However, Licensee did not have proof of purchase.
LPA Lopez did observed a fireplace in the family room which was barricaded and inaccessible for children in care. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill. Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted in the front entrance.

There are toys available for children. Appropriate sleeping arrangements in form of cots and cribs were observed.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family child care facility.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

LPA’s observed 3 cats, 2 dogs, Bird Habitat/ Sanctuary (various birds), Fish tank and Various Farms animals on the premises. LPA observed all animals to be off limits for children in care.

The licensee is observed to be operating within the license capacity limitations.

At 10:00 am children’s records were reviewed, including emergency information. LPA’s observed Child # 1 was missing individual sleeping log. -------------------------------pg. 3 of 5 ------------------------

The licensee has completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's Pediatric First Aid and CPR expires on 5/1/2024. There are first aid supplies available.

LPA observed that the Licensee do have proof of immunization record and the Mandated Reporter AB 1207 compliant Child Care Training Certificate on file.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA advised the licensee to access forms, regulations and quarterly updates on line at: www.ccld.ca.gov.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

During the exit interview, the LICENSEE Guadalupe Ornelas, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

LPA offered TSP Technical Support program on this date. Per Licensee, they will think about it.

Based on the LPA’s observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.

LPAs Roxana Lopez and Staicy Perry informed licensee Guadalupe Ornelas that this report dated 9/21/2023 document(s) 3 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPAs Roxana Lopez and Staicy Perry informed the licensee to provide a copy of this licensing report dated (insert visit date) that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.
