32 | During interviews conducted, LPA Lee was not able to obtain any direct evidence that went against or supported the allegation. LPA Lee observed that based on the number of teacher's hired and enrolled children in care, the preschool program has 2 teachers per classroom with an average of about 12 children per classroom. The facility did state during interviews that at occasions classrooms are combined during certain times of the day, but ratio is always maintained.
During the investigation, LPA Lee observed that Staff#1 would leave the classroom to use the restroom or for other personal reasons without notifying the other staff member in the classroom. This was observed by LPA Lee and also corroborated from interviews conducted during the investigation. Although it was observed that Staff#1 leaving a classroom did not cause the classroom to be out of ratio, LPA Lee advised the facility to remind the staff during meetings to communicate with each other when working in the classroom. Even if the teacher that is left alone by Staff#1 for about 5 minutes is still in ratio, the lack of communication when leaving from Staff#1 can potentially cause incidents due to the lack of supervision. For example if 1 teacher out of the 2 is changing a diaper of a child in classroom with 10 children, than the second teacher leaving without communicating during the diaper change can cause issues regarding supervision despite the proper ratio being maintained with 1 teacher for 10 children.
Based on the evidence collected during the investigation, the allegations that Staff are operating out of ratio may be valid. However, there is not enough preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegation is found to be unsubstantiated.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
