Licensing Program Analyst (LPA) Seung Lee conducted an unannounced complaint inspection. Upon arrival LPA Lee met with Megha Sahni.

During the course of this investigation LPA Lee made observations, reviewed documents, and conducted interviews in regards to the above allegation.

The complaint alleges that on 08/24/2023 at around 11:00AM a staff member was left alone with 19 children for about 10 minutes. During the inspection LPA Lee reviewed the camera footage for all preschool classrooms on 08/24/23 at around 11:00AM. LPA Lee observed that there was a total of 4 classrooms for the preschool program. LPA Lee did observe 1 classroom with about 18 children and 2 staff members. LPA Lee did observe the footage in this classroom from about 10:45AM until 12:45PM. At around 12:30PM, all of the children but 3 children were laying on their cots for nap time. The 3 children were observed to be sitting at the table during this time. LPA Lee observed 1 staff member (Staff#2) leave the classroom at around 12:30PM. After Staff#2 had left the room Staff#1 was inside the classroom with around 15 napping children

and 3 children at the table. Eventually the 3 children all went to lay down on their cots with the last child laying down at around 12:43PM. Regulations for child care centers states that 1 qualified teacher may supervise up to 24 napping children. A file review for Staff#1 did show that they were qualified to be a teacher with 12 early childhood education units. Although staff#1 was qualified to watch over up to 24 napping children, the camera footage observed showed that Staff#1 was left in a classroom at nap time with 3 children that were not napping. It took about 10 minutes for all 3 children to go lay down on their cots. This means that classroom was out of ratio for about 10 minutes when Staff#2 left Staff#1 in the classroom at around 12:30PM and went back into ratio when the last child went to lay down on their cot at around 12:43PM this is a potential risk to children in care.

Based on the information obtained during the investigation, the preponderance of evidence standard has been met, therefore the allegation that the Facility is out of ratio has been substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 1, article 6), is being cited on the attached LIC 9099D.

The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.

A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center. This requirement was not met as evidenced by the fact that
