32 | and 3 children at the table. Eventually the 3 children all went to lay down on their cots with the last child laying down at around 12:43PM. Regulations for child care centers states that 1 qualified teacher may supervise up to 24 napping children. A file review for Staff#1 did show that they were qualified to be a teacher with 12 early childhood education units. Although staff#1 was qualified to watch over up to 24 napping children, the camera footage observed showed that Staff#1 was left in a classroom at nap time with 3 children that were not napping. It took about 10 minutes for all 3 children to go lay down on their cots. This means that classroom was out of ratio for about 10 minutes when Staff#2 left Staff#1 in the classroom at around 12:30PM and went back into ratio when the last child went to lay down on their cot at around 12:43PM this is a potential risk to children in care.
Based on the information obtained during the investigation, the preponderance of evidence standard has been met, therefore the allegation that the Facility is out of ratio has been substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 1, article 6), is being cited on the attached LIC 9099D.
The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
