13 | On 11/10/2022 at 09:05 a.m., Licensing Program Analyst (LPA) Carolyn Tuba conducted an unannounced complaint inspection to deliver findings of the above allegations. A Covid risk assessment was conducted when entering the facility. LPA met with Director/Owner, Bertha Girgis, who guided LPA on a tour of the facility. There was a total of 0 children present with 0 staff.
Complainant alleged that Staff Transporting Day-Care children in an unsafe manner. Based on the Director’s own admission on 11/04/2022, LPA Carolyn Tuba clarified California Code Title 22 section 101225(b), which states that the manufacturer's rated seating capacity of the vehicles shall not be exceeded. Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation at this time is found to be substantiated. The California Code of Regulations, (Title 22, Division & Chapter) relating to this allegation have been cited on LIC 9099-D.
