Visit conducted in Spanish
On 11/8/2024 at 9:30 am, Licensing Program Analyst (LPA) Carolyn Tuba conducted an announced pre-licensing inspection for the above address. LPA met with Licensee, Maria Aquino. This is a relocation from facility number #192009660 for a large family childcare license. A fire clearance has been approved prior to the visit. The facility is part of the caseload that is currently assigned to LPA, Nolan Tcheng.

LPA took a census of 1 child in care who lives in the home. Licensee guided LPA on a tour of the home. Individuals residing in the home are 4 adults and 1 child. Per Licensee, hours of operation will be from 12:00 AM to 11:59 PM from Monday to Sunday and will not exceed 24-hour care at any time. Licensee states that she will care for children 3 months to 12 years of age.

This is a Townhouse within a gated community and is 2 -stories which consists of 3 bedrooms, 2 ½ bathrooms, formal living room, dining room, kitchen, garage, back patio and a sitting area located upstairs. Areas off limits to children include the 3 bedrooms, 2 bathrooms, kitchen, garage. The home was inspected for safety, comfort, cleanliness, telephone service, heating and ventilation, inaccessibility to poisons, detergents, cleaning compounds, medicines, and hazardous items that can pose a danger to children. Parents will be provided an access code to be able to enter the gated community. Stairs have a child proof gate to keep children from going to the upper floor. The kitchen will have a child-proof gate to keep children from entering.

Knives and other sharp utensils are kept out of reach of children. Cleaning products and laundry detergents are kept in the laundry area which is enclosed with accordion doors near the kitchen area and is locked with a child proof lock. Medication was removed from the kitchen and will be kept upstairs in the bedrooms which is an off-limit area.

Per licensee she is part of a food program and will provide breakfast, lunch, AM & PM snack and dinner depending on children’s schedules.

The downstairs bathroom which children will use was inspected and during today’s visit licensee installed a child proof lock on the cabinet under the bathroom sink and the medicine cabinet.

During today’s visit the Licensee also provided to the LPA the immunizations needed, updated facility sketches for inside and outside and updated information needed on the application and emergency disaster plan. The Statement of Acknowledgement Requirement to Report Child Abuse for the licensee and her assistant.

Licensee and her assistant have completed the required health and safety training including nutrition and lead, mandated reporting training which expires 2/2026 and the Pediatric First Aid and CPR which expires: 11/8/2025. Licensee and her assistant have provided proof of immunizations, MMR, Tdap, TB and influenza. Adults living in the home have completed the TB and have provided waivers for the influenza for 1 adult living in the home.

Licensee states there are no pets, and none were observed on the premises.

LPA observed age-appropriate toys and learning materials. A (2A:10BC) fire extinguisher was observed and was last serviced October 10, 2024. First Aid kit is available, including tweezers, surgical scissors, and emergency booklet.

Per Licensee there are no firearms in the home. LPA did not observe any during the inspection of the home. There is central heating and air in the home. Smoke detector and carbon monoxide located in the living room were tested and observed to be operable during today’s visit.

The gated community currently has swimming pool and jacuzzi and LPA inspected and conducted a Bodies of Water checklist. The licensee provided and updated facility sketch including the pool and found that the swimming pool and jacuzzi met all regulations for being appropriately fenced. Per licensee she will not be taking children to the pool area. (initials: ________)

LPA inspected the back patio which is enclosed by a cement wall that is taller than 5 feet and includes children’s toys and has imitation grass and a back gate. According to the assistant, the back gate must remain with no lock according to the fire inspector, but LPA suggested that the gate be checked and ensure it be latched properly each time children play out in the back patio. There is also the air conditioning unit that requires a barrier, so children do not have access to the unit.

Per licensee, children and infants will nap in the living room, and sleeping cots and crib are available. LPA provided safe sleep information in Spanish for the licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPAs also informed the applicants of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. LPAs reviewed with applicant that napping equipment should not block entrances or exits. Infant mattresses must be firm with tightly fitted sheets. Loose objects, bumpers, objects hanging, or objects attached to the cribs/play yards are not allowed. Each infant should have their own crib/play yard and bedding. LPA discussed LIC 9227 Individualized Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0-24 months, and the PIN 20-24-CCP.

Licensee Corrections needed are the following:
Licensee will provide a waiver for the adult living in the home for influenza.
Air conditioning unit requires a barrier, so children do not have access.
The following items will be corrected prior to obtaining a large family childcare license. Licensee will send photo and waiver to the LPA’s email by 11/12/2024.

The following was discussed with the licensee:
In the absence of the licensee a qualified adult must be present supervising the children; a qualified adult is an individual who has a valid and current adult/infant CPR & Pediatric First Aid certification, TB clearance, immunization, Mandated Reporter training certificate www.mandatedreporterca.gov, and a valid criminal record clearance associated to the facility license. maintained for a period of three years, even after children no longer are attending the facility.

Reporting Requirements: Any unusual incidents or injuries must be reported to the Department within 24 hours via telephone and within seven (7) days in writing.

Fire and safety drills must be performed every six months and documented for review by the Department.
Smoking is prohibited in a family childcare home. Children and Staff records must be maintained and updated as needed and must be available for review by the Department. No infant walkers, No Johnny jumpers, No saucer chairs, and any other item that falls into that category are not permitted in the facility.

Inspection Authority: All adults living and working in the home shall be made of aware of the Department’s right to inspection the home, which includes, but is not limited to the right to enter the home when children are being cared for, interview children and adults and review documentation.

The facility license number must be on all advertisements, publications, or announcements with the intent to attract clients.

Isolation for Ill children: When a child is ill, he/she shall be separated from other children (reference 102417(e) Operation of a Family Childcare Home). The isolation area for a sick child waiting to be picked up will be in the on-limit dining room of the home.

Liability Insurance was discussed; LPA advised applicant to review Title 22 Regulation 102417(m)(1) for additional information. Licensee states she does have liability insurance.

Parent Board was available with all required documentation.

OTHER INFORMATION THAT WAS DISCUSSED:
Never Shake a Baby, Sudden Infant Death Syndrome (SIDS) and Safe Sleeping practices.

Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

applicant confirms was provided to the property owner/landlord. The applicant obtained a signed Property Owner/Landlord Consent form (LIC 9149).

LPA provided Facility Entrance checklist for future annual inspections, Pre-License packet in Spanish and the Earthquake preparedness in Spanish and English for the parent board to be posted.

On this date, 11/5/2024, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Applicants were informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

A large family childcare license will be granted once corrections are submitted, and the department does a final application review. Once licensed, the Licensee is required to comply with the terms and limitations stated on the license.
