32 | Outdoor playground equipment is in a safe condition, free of sharp, loose or pointed parts. During inspection, LPAs observed fence located on right side of infant playground open and unable to close due to orange electrical cord. Director addressed immediately and closed gate. A technical violation citation issued. During inspection, LPAs observed cushion padding under the outdoor swing set coming undone causing a potential tripping hazard. A type B citation issued. There is adequate shade in the play yard. LPAs advised that no children shall be left without the supervision of a teacher at any time. There are no firearms stored on the premises. There are no pools or bodies of water at the facility.
LPAs reviewed 5 infant’s file and observed. Per children record review, LPAs observed files are incomplete either missing parent signatures or documents. A type B citation issued. Per children record review, LPAs observed one infant’s file missing LIC9227 Infant safe sleep plan. A type B citation issued. Per children record review, LPA observed three out of five files missing infant needs and services plan. A type B citation issued.
Per staff record review, LPA observed the following documentation maintained and updated: LIC-501: Personnel Record, LIC 508- Criminal Record Statement, LIC 9052- Employee Rights, LIC 503- Health Screening, Proof of immunization against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse. Per staff record review, LPAs observed 2 staff and director without EMSA approved 1ST aid/CPR certificate. LPAs observed one staff with CPR and Pediatric First Aid with EMSA approved sticker. Per staff record review, LPA observed one teacher missing infant units. A type B citation issued. The name of the childcare center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. LPAs reviewed the following documentation to be kept in facility: facility license, LIC610, PUB 393, daily schedule, PUB 269, fire drills and monthly menus.
Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
