Licensing Program Analyst (LPA) Ashley Claderon conducted an unannounced random annual inspection at the facility noted above. LPA was granted entrance at facility by Licensee, Quanisha Shuler. LPA explained the purpose of the inspection.

The Licensee operates as a Large Family Day Care Home. The operating hours are Monday through Sunday from 12:00 AM to 11:58 PM. The Licensee cares for children ages: infant to 12 years old.

All areas identified on the facility sketch were inspected. This facility is a single family home that consists of three (3) bedrooms, one (1) bathroom, living room, dining room, kitchen, garage, backyard and front yard. Areas that are accessible to children include: living room, dining room, one (1) bathroom and backyard (fenced) and front yard. Areas off-limits to children include: 3 bedrooms, kitchen, and garage. LPA observed a child safety gate installed in the kitchen.

Areas used by children were inspected for safety, comfort, heating, and cleanliness. The home has ceiling fans and a heating system. LPA did not observe fireplaces in the home. LPA observed living room transformed into a classroom setting, with age appropriate materials and toys. LPA Calderon observed kitchen area. Detergents, cleaning compounds, medicines, sharp objects and hazardous items that can pose a danger to children are made inaccessible in kitchen area, kitchen entrance has a baby gate in place. LPA Calderon observed at 10:28am Spectacide Bug Killer under kitchen sink, LPA informed Licensee any poisons are purchased and stored in the home are required to be locked with a key or combination lock. During visit poison was moved and stored in locked garage, deficiency cited.

Licensee stated having a volunteer assistant, volunteer not present during today's visit. LPA reviewed Facility LIS Personnel Summary ,volunteer not listed. LPA requested assistant to check on clearance via telephonically with LPA J.Culbet did not have sufficient information to locate individual. LPA requested Individual clearance documentation, Licensee was unable to provide documentation's. LPA gave a technical violation to ensure volunteer is fingerprinted cleared and associated. Per Licensee, volunteer was associated and cleared at previous licensed home, LPA stated to submit LIC9182 Criminal Record Clearance Transfer Request to licensing and LPA provided printed from. LPA also consulted Licensee on what records are needed for volunteers and advise to obtain before assisting at child care.At 12:24pm Licensee gave LPA child and staff records. Child #1 did not have a 15 min Infant Sleep Log, only record provided for Child #1 was LIC9227 Individual Safe Sleep Plan. Licensee was unable to provide/ locate records for Child #1, Child #4, Child #5 and Child #6, LPA Calderon unable to observe children's immunization records, LIC955A Parents Right, Identification and Emergency Contact, LIC282 Affidavit Regarding Liability Insurance, deficiency cited. Child # 2 and #3 had appropriate records in place but children where not observed at the facility during visit. LPA reviewed Licensee records, Pediatric First Aid and CPR expired on 7/2023, deficiency cited. Licensee was unable to provide Mandated Report Training Certificate and Per Licensee, needs to locate certificate, deficiency cited.

At 12:50pm LPA Calderon suggested TSP Program, Licensee stated is interested and to sign Licensee up for program to assist with facility operations. At a later time LPA will provide registration information to Licensee for enrollment.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the Licensee, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS. Based on today’s visit, Per California Code of Regulations Title 22, deficiencies provided on LIC 809-D pages. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form via email.

A notice of site visit was given via email and must remain posted for 30 days. Due technical issues with LPA Calderon's printer reports/ appeal rights will be provided via email.

Based on observation LPA Calderon observed Licensee placing a light loose sheet for Child #1 for child to sleep on, Per Licensee does not have fitted sheets for play yard, the licensee did not comply with the section cited above in [1] out of [1] person which posesa potential health, safety or personal rights risk to persons in care.
