Licensing Program Analysts (LPAs) Jeanette Estrada and Jonnisha Culbert conducted an unannounced annual inspection. LPAs met with Licensee Nicole Austin and informed her of the reason for the visit. The facility provides care to children ages 6 weeks to 12 years old and is open Monday to Sunday 12AM to 11:50PM. Licensee was advised care cannot be provided for a continuous 24 hour period. LPAs observed 4 children present.
This is a one story, 4 bedroom, 2 bathroom home with a living room/ dining room, kitchen, laundry room, enclosed backyard and garage.
Per Licensee areas on limits to children are: Living room/dining room, 2 bathrooms, one bedroom used as a daycare room and the backyard. Per Licensee areas off limits to children are: 3 bedrooms (kept locked), kitchen (safety gates prevent access), laundry room(next to kitchen) and garage (only accessed through outside).
All areas that are accessible to children were inspected for safety, comfort, and cleanliness. The following was observed and reviewed during this inspection: LPA observed required posted documentation- Facility license, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPAs observed a facility roster. There is a carbon monoxide detector and a smoke detector in the facility. At the time of the visit LPAs were unable to check the operational status of the detectors due to children napping. A disaster drill was available. The last documented drill was conducted 12/8/2023. Licensee was advised to conduct a drill every 6 months. LPA observed a 2A10BC Fire Extinguisher in the facility which indicated full and was purchased on 4/25/23. The home maintains telephone service (cell phone/landline). Food may be provided by Licensee or parents may have the option to bring food from home. Licensee was reminded if children bring food from home it must be labeled with the child’s name and properly stored or refrigerated. There are toys and other age appropriate materials available for children to use in the day care room. Sharp objects, detergents and cleaning compounds were inaccessible to children in care.

Knives are kept in a latched kitchen cabinet, cleaning compounds and detergents are kept in the locked off limits laundry room in an upper cabinet. Personal medication is stored in one of the off limits bedrooms. Per Licensee they plan to administer medication if needed. Children's medication will be kept in an upper kitchen cabinet inaccessible to children in care. At this time there are no children who require medication.
The facility has central air and heating. LPA did not observe any fireplaces or wall heaters in the facility. Children nap in the living room/day care room and they are provided appropriate napping equipment. Children have access to both restrooms in the facility. Both restrooms have latched cabinets under the sink. Personal items are kept in these cabinets. No accessible hazards were observed in the restrooms.
Children have access to the backyard for outdoor play. The backyard is fully enclosed. Per Licensee, children are supervised while playing outside. LPA observed appropriate toys and materials available for children outside. Poisons are kept in the off limits garage. Licensee understands that all poisons must be locked, not only inaccessible to children. Isolation area for sick children waiting to be picked up is in a section of the living room, separated from other children while under adult supervision. Per Licensee, there are no firearms or weapons stored in the home. LPA did not observe any pools or spas, or other bodies of water. There is 1 pet dog in the home which is kept in the off limit area of the home.
Infant Care: Currently there are two infants enrolled. LPAs observed one play yard in the living room. Upon arrival, one infant present was laying in an enclosed play pen. The following was discussed with the Licensee, napping equipment shall not block entrances or exits, Infants shall not be swaddled in care. Car seats shall not be used for sleeping. LPAs discussed the Safe sleep regulation, including LIC 9227 Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0-24 months.
Children's records were complete.
Licensee's Pediatric First Aid and CPR which expired 3/2024. Licensee's Mandated Reporter Training expires 10/19/24.

During inspection all children were observed to be treated with dignity and respect, they were observed to be receiving safe, healthful and comfortable accommodations, furnishings and equipment, and free from corporal and/or unusual punishment. LPA discussed the safe sleep regulations with the Licensee and discussed the child care licensing safe sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a plan for providing IMS must be submitted to the Department. Licensee was informed of the Mychildcareplan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and resource and referral agencies (R&Rs) throughout California.
During the exit interview, the Licensee Nicole Austin, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO in FAS.

California Code of Regulations, (Title 22, Division 12, Chapter 1), are being cited on the attached LIC 809D regarding the expired Pediatric first aid/cpr certification.


A notice of Site Visit was given and must remain posted for 30 days. Appeal rights were provided.
Exit interview conducted and report was reviewed with the Licensee, Nicole Austin.
