13 | On 10/3/2024, Licensing Program Analyst (LPA) Priscilla Zamudio conducted an unannounced complaint inspection at facility to deliver finding for the above-mentioned allegation. LPA met with Licensee, Sheri Tate and completed a census.
There were 8 children in care. LPA observed a stock tank pool in the backyard currently empty and covered. It was approximately 2 X 8 feet wide. The pool was located behind the house, in front of the daycare room window. It was surrounded by a fence approximately 3 feet, made out of garden wire mesh, wood slats and chicken wire. Entry to the pool area was through a wrought iron garden/arbor arch with short gate. The installed fence material and gate did not meet Title 22 Regulations.
During the course of the investigation, LPA Zamudio conducted interviews, and reviewed pertinent information. Interviews revealed the pool was filled with water when not in use on one or more occasions during daycare hours. In addition, social media images on licensee’s business account showed children in the daycare room with tank pool in the background near the window.
Based on the information gathered through interviews, documentation and LPA observation, the preponderance of evidence standard has been met, therefore the allegation is found to be SUBSTANTIATED. The following deficiency is in violation of Title 22, Division 12 CCR, Chapter 1 is being cited on the attached LIC 9099D.
This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Licensee Sheri Tate was provided appeal rights.
