On 07/23/2025, Licensing Program Analysts (LPAs) Pa Kou Vue and Miguel Herrera conducted an unannounced inspection to deliver the findings for the above complaint allegation received on 05/28/2025. LPAs met with Director Jennifer Mays and explained the purpose of the inspection. A tour of the facility was conducted inside and outside, and a census was taken.

During the course of the investigation, LPAs interviewed staff, conducted facility observations, reviewed and obtained records to gather additional information to investigate the above allegation, Outdoor equipment presents a hazard to day care children. Through evidence obtained, LPAs corroborated that on 04/16/2025, child 07 was jumping off the umbrella base stored in the outdoor play area, when she fell and landed on top of the base resulting in an injury. Therefore, the preponderance of evidence standard has been met, the above allegation is found to be SUBSTANTIATED.

LPAs discussed outdoor activity space CCR 101238.2(c) and for incidents to be reported to Childcare Licensing (CCL) within 24 hours of occurrence. Director stated she understood.

Exit interview conducted and report was reviewed with Director Jennifer Mays. Appeal rights were provided.

Per Title 22, Division 12, Chapter 1 of the California Code of Regulations, the following deficiency is being cited: (see 9099-D page).

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.

Director Jennifer Mays stated during non-season or when NOT in use the umbrella and base will properly be stored from daycare children to prevent hazards to children present.

Based on LPAs interviews, observations, records review and records obtained, the license did not comply with the section cited above. Licensee did NOT ensure the outdoor play area was free of hazard resulting in child 07 sustaining an injury which poses/posed a potential health, safety or personal rights risk to persons in care.
