Licensing Program Analysts (LPA) Martha Jimenez-Villanueva met with licensee Wendy Garcia for an unannounced annual inspection. LPA explained the nature of today’s inspection. Licensee was alone and had 3 children in care: one infant and two toddlers. Days and hours of operation are Monday to Friday from 6:00AM to 6:00PM, Saturday 6:00AM to 3:00PM. Adults living in the home are the licensee, licensee's husband, licensee’s one son and one daughter. Children living in the home are two children ages: sixteen- and eight-year-old. LPA observed one story home.

A review of staff records on 10/16/2024 indicates that not all Facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Jose A Centeno (licensee’s son) does not have fingerprint clearance. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA inspected inside and outside of the home. LPA observed no fireplace, no wall heater, no stairs, and no bodies of water. Licensee stated there are no weapons and no pets. LPA observed a fully charged 3A40BC fire extinguisher. Carbon Monoxide detector and smoke detector were operable. Sharp objects, medicines, poisons, and cleaning supplies are inaccessible to the children and stored in a top kitchen cabinet and in the garage. Backyard is fenced. Off limit areas: three bedrooms, one bathroom, garage and back of backyard.
LPA observed licensee and licensee’s helper CPR and First Aid Certification expiring on 09/2025 both. LPA observed licensee and licensee’s helper completed Mandated Reporter training dated 11/06/2023 both. Licensee stated helper arrive after three PM. Needed documentation for SB 792 which requires immunization against Pertussis, Measles, and Influenza as well as TB testing is on file for licensee and licensee's helper.

LPA took a picture of a current roster of the children and a fire and disaster drill log which was last completed on 06/07/2024. LPA reviewed five children's files and observed all forms are completed and children have current immunization records exempting child 3 missing LIC 9227. LPA observed current safe sleep log for infants in care. LPA observed LIC282 in children's files.

Supervision of children was discussed with licensee, and she understands that she must be present in the home during day care hours and ensure that the children are supervised at all times. Licensee understands her capacity options and she understand that she cannot have more than 14 children in the home at any time. Applicant understands that children (her own) residing in the home count as part of the capacity of her license until they reach the age of ten years old. Licensee stated she does not transport children. LPA reminded Licensee that children are never to be left in parked vehicles and must use appropriate car seats according to the child's age/weight/size.



LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at
https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Exit interview conducted and report was reviewed with the licensee Wendy Garcia in Spanish.



During the exit interview, the LICENSEE, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

The following type A and B deficiencies were cited on the attached page (809-D). Licensee was informed that failure to correct the deficiencies by the specified Plan of Correction (POC) Due Date may result in assessment of civil penalties in the amount of $100 per day per violation until the correction is made.

LPA Martha Jimenez-Villanueva informed licensee Wendy Garcia that this report dated 10/17/2024 document (1) Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Martha Jimenez-Villanueva informed the licensee Wendy Garcia to provide a copy of this licensing report dated 10/17/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
