On 12/12/24, Licensing Program Analyst (LPA) Cindy Castro, made a subsequent complaint investigation inspection, for the purpose of delivering complaint findings and met with Site Supervisor, Evelyn Fuentes. It has been alleged that Staff prevented day care child from participating in day care activities and Staff spoke to day care child in an inappropriate manner.

LPA, previously conducted inspections on 10/03/24, 11/07/24 and 12/05/24 to initiate and conduct investigation inspections. LPA met with Site Supervisor to discuss the allegations, conduct interviews, make observations, and request documents.

During the investigation, LPA conducted interviews with four staff, four parents, and seven children from 10/03/2024 to 12/05/2024. Site Supervisor denied allegations and stated she has not seen staff prevent a child from doing activities. Site Supervisor added that she has never seen staff use inappropriate language or tone of voice with children. Continued on LIC9099-C

Furthermore, Site Supervisor noted that all children are to be always doing an activity, if teacher is busy with a group of children, then they rotate the children’s groups. All staff (S1-S4) reported that children are redirected to other activities if they are not listening and provided with a time to relax and calm down.

Site Supervisor reported that there was an incident in which Child (C1) was waiting for parent to pick up and ran through the classroom glass door that leads directly to center main entrance. Site Supervisor added that S2 called out C1’s name since S2 did not see parent coming through the main door. S2 recalled incident in which C1 got up and started running and S2 thought that C1 was going to run out. S2 reported saying to C1 “No, no wait don’t leave” because S2 though that C1 was going to leave. S2 reported that it was an instant reaction, to being scared and thinking C1 was leaving. S3 recalled incident in which C1 saw parent, got excited and started running. S3, heard S2 say to C1 “Hey, don’t leave” because S2 was scared that C1 was going to run out to the street. S3 stated that S2 did not yell at C1 but wanted to stop C1 from running out to the street. S4 stated that S2’s voice can be loud but would not be interpreted as scary or yelling. S3 reported raising their tone of voice sometimes when a child is going to fall, bite another child, run to the playground, or run towards the door outside, to prevent accidents.

Children interviews (C1-C7) did not corroborate allegations and there were no reports of yelling or being excluded from participating in daycare activities. C1, stated “I did not hear yelling or screaming”. C2-C7 all reported feeling safe at the daycare center.

In addition, parent statements (P1, P2, P4, P5) did not present any concerns about staff yelling or preventing children from participating in daycare activities and did not corroborate the allegations.

Based on the information gathered during this investigation, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with Site Supervisor, Evelyn Fuentes. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
