32 | Furthermore, D1 stated that C1’s parent brought wipes to the school specifically asking the teachers to use them with their child, but D1 told the parent teachers could not use the wipes on their child. Staff interviews (S1-S4) provided corroborating evidence to confirm that when a child says ‘no’ staff are not allowed to touch the child, as it would be violating their personal rights. S1 specifically stated it is against a child’s rights to wipe them after using the bathroom if they tell us no. We have had a child (C1) who cannot wipe properly and when we ask C1 if we can help them, they tell us no, so we don’t do it. S2 stated that they cannot physically help a child without their consent, they can only guide the children. S3 specifically stated that they are aware of a parent who has asked the teachers to help their child (C1) as the child has gone home not properly cleaned, but since C1 tells us no, we do not help them. In addition, S3 stated that if the child asks a teacher for help the teachers are then able to touch the child. S1, S2, and S3 acknowledged the child’s need for assistance with wiping when a parent gave them suggestions on how to clean C1, but teachers told the parent they cannot help C1 without C1’s consent.
Furthermore, S2 – S4 all stated that if a child wears a diaper or pull-up and a child tells a teacher no to being changed the teacher still changes the child acknowledging that they need to keep them clean. S2 specifically stated that it doesn’t matter how old the child is, if a child has a dirty diaper, teachers change them. S4 stated that the facility would not keep children in soiled clothes, even if a child said no, they would change the child.
Statements provided by A1 and A2 reveal that their children have come home with diaper rashes. A1 stated that several times their child would have a dirty diaper, specifically that their diaper would be full, occasionally leaking from not being changed. Both A1 and A2 stated they spoke with teachers on multiple occasions and asked that their children be properly cleaned. A2 also informed the facility that their child is not fully potty trained and asked them to help their child after they use the restroom, but teachers declined stating they cannot help their child as it would be violating the child’s personal rights.
Further evidence revealed the facility waits for the child to ask or give permission to have their face or nose wiped when dirty. D1 confirmed that teachers do not just wipe children’s faces, teachers wait until the child is ready and has let them know it is ok. LPA observed multiple children with mucus running down their faces. A1 & A2 both confirmed their children would be dirty on several occasions upon pick up as well as observe multiple children with mucus running down their faces and into their mouths.
