Licensing Program Analyst (LPA) Matthew Gallo met with Licensee Deva Hauber for the purpose of an unannounced required 1-year inspection. At 9:10am, LPA observed a total census of 5 preschool children supervised by licensee.

Operating hours are 8:30am to 1:00pm, Monday through Thursday. The facility closes for the summer.

Licensee guided LPA on a tour of the facility, and a health and safety inspection was conducted in all areas accessible to children. Off-limits areas include all downstairs, outdoor shed, and detached cabin. Licensee acknowledged that children must never enter these areas. LPA observed the required postings, a working phone, 2A10BC fire extinguisher, and functioning smoke and carbon monoxide detectors. Licensee stated there are no weapons in the home and LPA observed toxic and hazardous items to be inaccessible to children. Open-faced heater is fenced to prevent access to children. Outdoor yard is unfenced, and licensee understands that 100% supervision of children is required in unfenced areas.

There is a duck pond located within a fenced garden in the front yard that has a rough perimeter of 5x5 feet and is approximately two feet deep at its center. The fence of the garden is over 5 feet tall. However, the spacing between joints in the wire fencing would not deter a child from climbing. In addition, the gate to the garden does not feature a self-locking mechanism as required by regulations.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA reviewed 6 children’s files and observed them to be complete. A current roster is being maintained and fire and disaster drills are documented. Current CPR and First Aid certification was verified and expires 10/2024, and AB 1207 Mandated Reporter Training was verified for the Licensee and expires 5/2025.

Licensee does not accept infants. In the case this policy changes, LPA discussed safe sleep regulations with licensee and referenced the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.



Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Licensee acknowledges, that FOR TYPE A DEFICIENCIES ONLY upon receipt, licensee shall post LIC 809D with Type A deficiencies for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the licensee. LIC 9224 and Appeal Rights were provided.

Exit interview conducted and report was reviewed with the licensee Deva Hauber. A notice of site visit was given and must remain posted for 30 days. Appeal rights and copy of regulations regarding pool fencing also provided.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on observation, the licensee did not comply with the section cited above in the case of a duck pond located in a fenced garden area. Although the garden fence was 5 feet tall, the space between joints in the wired fencing would not prevent climbing, and the gate to the area does not feature a self-locking mechanism. This poses an immediate health, safety, or personal rights risk to persons in care.
