During investigation, LPA Tran interviewed 5 staff on 05/24/2023 and 5 children on 06/20/2023.
During staff interviews, 5 out of 5 staff denied that they have or have witnessed any staff at the facility, ever allowed the children to urine in a used urine bag. All interviewed staff described the procedure of using the portable potty seat was to change the old bag and place a new bag for after each use per child. Staff only uses the portable potty seat during nap time and if there is an emergency if only one staff is supervising a group of preschool children (max is 12 children). When interviewed, S1 stated that S1 had been teaching in the pre-K classroom (4-5 years old) for about a year. According to S1, this group age of children were supposed to be already potty trained and S1 should not be involving in wiping the children in S1's class but to ensure S1 assisted the children from outside of the bathroom stall.
During children interviews, all interviewed children denied that they ever used the portable potty seat without the teacher changing out the bag.
Based on the interviews conducted with 5 staffs and 5 children, there is insufficient evidence to corroborate the allegation that Staff are allowing daycare children to be soiled while in care and Staff are not providing comfortable accommodations for the daycare children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that Staff are allowing daycare children to be soiled while in care and Staff are not providing comfortable accommodations for the daycare children, did or did not occur, therefore the allegations that Staff are allowing daycare children to be soiled while in care and Staff are not providing comfortable accommodations for the daycare children are UNSUBSTANTIATED.
Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Rebekah Bay.
