On 2/20/2025, Licensing Program Analyst (LPA), Alma Castro, conducted an unannounced subsequent visit to the facility to deliver the findings for a complaint that was initiated on 01/16/2025. LPA met with Director, Sheila Rafat-Saint. and explained the reason for the visit. LPA was led on a tour of the facility and observed a total of six (6) pre-k children with two (2) teachers in one classroom, four (4) children and two (2) teachers in the toddler classroom, 10 children in the early preschool classroom with two (2) teachers and 12 children in the preschool classroom with two (2) teachers. The facility was operating within the licensed capacity as specified on license.

On 01/13/2025, the Orange County Regional Child Care Licensing Office received a complaint with the allegations listed as: (1) Staff do not provide adequate care and supervision to the daycare children, and (2) Staff are operating out of ratio

On 01/16/2025, LPA made an unannounced visit to the facility and interviewed staff and children. Director provided LPA with facility roster, sign in and out sheets, ratio data from 01/13/2025, written incident report dated 01/13/2025, and other documents pertinent to the investigation.

During investigation, LPA conducted observations on supervision during inside and outdoor playtimes. LPA Castro interviewed seven (7) staff members. LPA Castro attempted to interview seven (7) children, but only two (2) were eligible. LPA also contacted seven (7) parents, but only three (3) responded and were interviewed.

Regarding allegation (1) Staff do not provide adequate care and supervision to the daycare children during LPA’s observations on supervision, LPA observed teachers and assistants providing supervision during indoor/outdoor time with the children in care. All seven (7) interviewed staff provided consistent statements about following facility’s supervision procedures discussed during Supervision Training in September 2024. All three (3) interviewed parents did not disclose any concerns regarding the allegation regarding adequate care and supervision. The three (3) interviewed children did not disclose anything to support the allegations. During record review, LPA examined Supervision procedures (Examples: Practice Active Playground Supervision, Playground Supervision Training, Have an Appropriate Number of Supervisors, Know the Playground, etc..). LPA also reviewed the following documents: adequate trainings for staff procedures regarding care and supervision.

Regarding allegation (2) Staff are operating out of ratio, during LPA’s observations, LPA observed facility operating within its license and capacity. All seven (7) interviewed staff provided consistent statements about the facility’s compliance with ratio. The two children that were eligible to be interviewed did not disclose anything regarding the allegation. All three (3) interviewed parents did not disclose any concerns regarding the allegation regarding ratio. During record review, LPA Castro examined the All Team Meeting itinerary (Topic Discussions: Ratio/Head Count, Capacity, Supervision Classrooms, Restrooms and Outdoors, etc). LPA also reviewed preschool student attendance, staff time card records that reflected the facility’s compliance with ratio.

The Orange County Regional Child Care Licensing Office has investigated the complaint alleging that (1) staff do not provide adequate care and supervision and (2) Staff are operating out of ratio. Based on the information gathered from LPA’s interviews and record reviews, although the allegation may have happened or is valid, there was not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are unsubstantiated.

No deficiencies cited.

A notice of site visit was given and must remain posted for 30 days.
