Interview with the complainant: The complainant remained anonymous; no contact was made with the Department.
Interview with staff: On 12/27/2023, LPA Bootorabit interviewed five (5) staff at the facility. Four staff denied the allegations were true. One staff mistakenly believed the facility was out of ratio but based on his/her explanation of the situation, the facility did not appear to be out of ratio or over capacity.
Interview with Parents: On 2/21/2024, the LPAs called nine (9) parents requesting an interview. Four of the nine parents were reached and interviewed. None of the parents interviewed expressed any concerns.
Records Review and Observations: On 2/21/2024, the LPA reviewed the LIC999 Facility Sketch and the facility’s capacity as specified in the latest license issued to the facility. The license capacity is not specific to any one specific room, but rather to the facility. The complainant made allegations about a toddler program. However, the facility doesn’t have a toddler program. The LPA reviewed sign in sheets for children and staff for 12/19 and 12/20. Based on the records reviewed the facility was operating within staff to child ratios.
Based on the records review and interview statements, the preponderance of evidence standard has not been met. Although the allegation that the facility operated out of ratio may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.
An exit interview was conducted with Director Derek Wainmann. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.
