Licensing Program Analyst (LPA) Nguyen Nick Tran conducted an unannounced complaint inspection to deliver the findings for the above allegations. This is a continuation of the investigation initiated on 10/25/23. At 9am, LPA Tran met with Assistant Director Amber Lopez, who guided LPA on tour of the facility. Census was taken and observed were 46 children and 6 staff.

A review of the Facility Personnel Report Summary on 10/25/2023 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 10/24/2023, the Regional Office received a complaint with allegations alleging (1) Staff did not provide a day care child adequate supervision, resulting in child sustaining an injury, and (2) Staff did not appropriately handle an injured day care child.

During investigation, LPA interviewed 4 staff members, who were presence on the date of the incident and observed the injury, and 6 parents. LPA also reviewed staff's CPR & First Aid training certificates, Police Report, Child Protective Service (CPS)'s report and reviewed the camera footage of the incident.

All interviewed staff provided a consistent narrative of the incident, in which, C1 was reported playing in the classroom and C1 was observed slipping on a plastic mat that was placed on the classroom floor by other children, C1 fell to the side and hurt C1's right foot. Staff #1 (S1) came to assist C1 and assessed the injury. C1 was not able to stand and had pain on C1's right leg. S1 carried C1 to the changing table and called Staff #2 (S2) for help. S2 arrived to the classroom shortly after S1 called and carried child to the Director's office, where C1 was laid down on a mat and Staff #3 (S3) called to inform parents. C1 was taken to urgent care by parents. Interviewed staff also provided consistent responses about supervision procedure including the children in care are to be supervised at all times. S1 stated as soon as C1 fell, S1 went to assess C1 and when C1 was not able to stand due to pain on right foot, S1 carried C1 to the changing table. S2 stated when S2 came to the classroom to assist S1. S2 observed C1's right foot was swollen and immediately carried C1 to the office, where C1 could be placed on a mat until parents were contacted and arrived. All interviewed parents provided good feedback about the facility and shared no concern related to the allegations. LPA did not interview the children because they were too young to be interviewed.

During record reviews, the CPS and Police Report did not reveal substantial findings regarding allegations did occur. When reviewing the video footage of the incident, LPA observed 2 teachers, S1 and Staff #4 (S4) were in the classroom supervising 9 children, when C1 was hopping on the classroom floor and slipped on a mat on the floor and fell on floor. C1 was assessed for injury by S1 and was carried to the changing table after S1 made a call to the Director. S2 came a few minutes later and carried C1 to the Director's office. LPA did not observe any concern regarding the allegations in the video footage. LPA also verified that all 4 staff who were present at the time of the incident, were trained in CPR & First Aid and at least 1 staff has a current CPR & First Aid certificate.

Based on the information gathered from LPA interviews conducted with 4 staffs and 6 parents and record reviews of CPS and Police Report, video footage of the incident and staff's CPR and First Aid certifications, there is insufficient evidence to corroborate the allegations (1) Staff did not provide a day care child adequate supervision, resulting in child sustaining an injury, and (2) Staff did not appropriately handle an injured day care child. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove (1) Staff did not provide a day care child adequate supervision, resulting in child sustaining an injury, and (2) Staff did not appropriately handle an injured day care child did or did not occur, therefore the allegations are unsubstantiated.

Appeal Rights were explained. The Assistant Director was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Assistant Director Amber Lopez.
