Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 11/29/23, LPA met with Director, Lisa Calvillo and informed the director of the purpose of the visit. The director guided LPA on a tour of the facility and a census was taken. The overall census observed was 8 staff and 0 children.
A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 11/28/23 a complaint was filed with the Licensing office alleging (1) Staff did not accord child dignity in their relationship with staff (2) Staff yelled at child. Reporting Party (RP) stated the staff yell at child (C1) and treat C1 differently than other children. The RP states the child no longer wants to attend the childcare. The RP states that when C1 started humming the staff yelled at C1 to stop. The RP states the other child continued to hum but staff did not ask the child to stop and did not yell at the other child.

During the course of investigation, LPA interviewed 6 staff members, 7 children and 4 parents, and reviewed records.

Regarding allegations (1) Staff did not accord child dignity in their relationship with staff.

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed a staff violate a child’s dignity in their relationship with a staff. Staff 1 (S1) stated “We talk to the children and let them know that it's not ok what they are doing. We redirect them to the Director if we need to and let their parents know”. S4 stated, “Staff always give verbal warning and if the behavior continues. We let the director know and she will talk to the child then she will talk to the parents if it behavior continues”. S5 stated, “We talk to the children, to help calm them down. A lot of verbal conversation. If they don't want to follow or listen, we ask another teacher to help assist and talk to the child and then we ask for the Director for assistance, if the child doesn’t listen to us. For injuries, we complete an incident reports, and Director will talk to the parents”.

Regarding allegations (2) Staff yelled at child.

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed a staff yell at children. S2 stated," when a child displays a challenging behavior and it continues, the staff inform the director or operational director,and they will speak to the child. The director or operational director do speak to child in a direct and firm manner, because if it is brought to them, that means the child is not listening or following teachers guidance. They will meet with parents if behavior continues. Director always inform parents, if director or operational director spoke to their child. S4 stated, “I haven’t witnessed staff yelling. Staff sometimes uses a firm voice, but not yelling”. S5 stated, “I wouldn't say yelling but sometimes S1 uses a firm tone to get the children’s attention”.

LPA Duron interviewed 7 children. All 7 interviewed children did not reveal any staff violating their rights.

LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility.

Based on the information gathered from LPAs’ interviews, observation, and the reviewing of records, there is insufficient evidence to corroborate the allegations: Staff did not accord child dignity in their relationship with staff. Staff yelled at a child. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.



The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
