On 09/14/2023, the Regional Office received a complaint with allegation alleging adult in home spanks day care child. During a confidential interview, Reporting Party (RP) shared that RP suspected Child #1 (C1) got spanked by Adult #1 (A1) at the day care. According to RP, after RP observed C1's flinching, RP was asking C1 several questions, and C1 described how C1 was spanked on the buttocks by A1. No injury was reported.
During the investigation, LPA interviewed 2 adults who provide care for the children at the facility and 6 parents.
All interviewed adults denied that they spanked any child in the day care. Both interviewed adults stated that they give redirection to the children in care, have the children sit next to them and talk to the children about their behaviors and inform the parents if needed. All interviewed parents responded with good feedback for the facility and no concerns related to the allegation. During parent's interview, LPA was informed that C1 gave inconsistent responses, when C1 was asked if C1 was spanked at the day care. LPA was not able to obtain parent's consent to interview C1. LPA also attempted to interview 11 current children at the day care on 10/19/2023, however, all current children do not qualify for the interview.
Based on the information gathered from the interviews with 2 adults who provide care for the children at the facility and 6 parents, there is insufficient evidence to corroborate the allegation that adult in home spanks day care child. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove that adult in home spanks day care child did or did not occur, therefore the allegation is unsubstantiated.
Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Licensee Monica Silveira.
