Licensing Program Analyst (LPA), Mila Quinto conducted an investigation visit to the facility to deliver the finding. Upon arrival, LPA met with director, Nikki Brzuska. Census was taken. There was a total of 24 napping preschool children with 2 staff members.

A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The complainant alleged Facility did not comply with child’s admission agreement. According to the complainant, Child 1’s (C1) admission was terminated immediately without notice after the parent of C1’s employment was terminated from the other location.

On 6/7/23, LPA interviewed the director. According to the director, on 5/31/23, received a call from the Director of Operations (S1) to pack up C1’s belongings as Parent 1 (P1) will be arriving to pick up C1 and belongings. The director stated was not aware of the reason why C1 was disenrolling as P1 works at another location. According to the director, P1 requested for the refund for summer activity as P1 informed director that C1 will not be attending.

On 6/9/23, LPA interviewed P1. P1 stated was provided a document to sign regarding agreement of the summer schedule. However, P1 was unable to work the summer schedule provided and was only given 1 day notice of the schedule. P1 stated S1 terminated the employment and terminated C1’s enrollment. The enrollment fee was waived as part of the employment benefits. P1 stated S1 did not ask if they would like to continue the enrollment and pay tuition.

On 6/09/23, LPA conducted a phone interview with the Director of Operation (S1). S1 stated they have 3 childcare locations and P1 was working at location one of the locations and C1 was enrolled at another location. According to S1, P1 was provided the summer work schedule; however, P1 expressed could not work the hours provided. S1 stated there was multiple verbal communication with all staff regarding the summer schedule. S1 stated P1 requested a specific schedule but was unable to accommodate. After P1 declined the summer schedule, S1 stated since P1 requested for a refund for the summer activity for C1, which indicated P1 was disenrolling C1. S1 also included, the employees receive free childcare as part of the employee benefits. P1 did not request to keep C1 enrolled as the employee benefits will no longer apply and C1 would be enrolled at regular rates.

LPA reviewed the Staff Member Child Care Policy covering the employee benefits for childcare and indicates the discounted rate.

Based on interviews conducted and record review, the complaint alleging the facility did not comply with child’s admission agreement is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.
