Licensing Program Analyst P Rivas conducted an unannounced annual inspection in order to complete visit commenced on 11/21/22. LPA and Teacher Beverly Menkin toured the facility inside and outside and the floor and yard plan (LIC 999) were verified. The facility is licensed to serve children agesh to 2 years of age in Rooms 103, Preschool and Pre-K only; .Monday through Thursday, 7:30 AM to 5:30 PM. Fridays close at 5:00pm. Census was taken in individual classrooms. The overall census was 3 teachers and 5 prek children. During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. LPA was later met by Director Sharon Alkin and continued inspection.
In conjunction with the unannounced required annual visit, Licensing Program Analyst (LPA) Patricia Rivas conducted a case management visit. LPA met with Director Sharon Alkin to discuss the Lead Sampling Testing conducted on 09/27/2022. Director was advised on 11/21/2022 that the Lead Sample Report was to be posted. Director provided LPA’s copies of all documentation requested regarding Lead; LIC 999 Facility Sketch, LIC 9275 and LIC 9276. LPA Rivas confirmed that Director had posted the Lead Sample Report during visit on 11/21/2022.

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

During the inspection of the indoor activity space, items which could pose a danger to children (detergents, cleaning compounds, and medications) were observed to be stored out of the reach of children. Poisons/Hazardous Items are not kept on the premises. Food prep areas were clean and sanitary. Food is brought from home. Food is properly stored. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. There is drinking water available to children indoors

emergency drill within the past six months. The facility has a working carbon monoxide detector and fire extinguisher. Facility met all posting requirement. The California Child Passenger Safety Law was posted by the entrance of the facility


The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height and is separate from preschool outside activity space.
The surface of the outdoor activity space was well maintained and free of hazards. The cushioning material ( sand commercially produced for the purpose) around the climbing equipment, swings, slides and other similar equipment appeared to be enough to absorbs falls. Drinking water in the outdoor activity space is provided by filtered container and cups . The outdoor equipment and toys were in good repair and free of sharp edges. There are no bodies of water present at the facility. The facility grounds were safe, sanitary and in good repair.

Staff files were reviewed for staff present during the facility inspection on this date, 8 out of 8 staff files were reviewed. Health screening and immunization's as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1596.7995 states, a person shall not be employed or volunteer at a day care center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed child care providers, administrators, or employees of a licensed child day care facility to complete the mandated reporter training, and to renew the training every two years During today’s file review 8 out of 8 staff have a Mandated Reporter Training Certificate provided in file At least one staff member present possesses current EMSA approved Pediatric CPR/First Aid certifications, which expires 07/2023
Children's records were reviewed, and there was a separate, complete and current record for each child. A random sample of 5 of children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. Sign in/out procedure was reviewed for compliance. The person who signs the child in and out uses their full legal signature and records the time of the day.

This facility does provide Incidental Medical Services.
LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. In reference to the Lead Testing;
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires all licensed Child Care Centers (CCC’s) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five years after the date of the first test. Community Care Licensing was notified that lead water testing conducted at the facility on 09/2722 failed allowable limit for lead. The purpose of today’s visit is to follow up lead testing results of Action Level Exceedance (ALE).
Instructions for required lead testing are outlined in PIN 21-21-CCP. This PIN which contains Written Directives, have the same force and effects as the regulations contained in Title 22 of the California Code of Regulations.

Child Care Centers are expected to use an Environmental Laboratory Accreditation Program (ELAP), for lead testing. Accreditation from the California Environmental Laboratory Accreditation Program, known as an ELAP laboratory, is equipped to measure the amount of lead in parts per billion (ppb) unit of measurement.

LPA observed outlet C(6.6ppb) and G (5.8 ppb) in Room 2 were made inoperable via large clear trash bag. Outlet G is a drinking fountain in the middle of the room, behind the restrooms. Outlet C is located on the left side of the room near a closet. Also was viewed an "out of Service" Sign on sinks near outlets C and G.. Facility provides water for children in pitchers from outlets that were not deemed an action level exceedance. and britta filtered water. Children are also allowed to bring their own water bottles. Facility also has emergency water in bags that are readily available for all who enter the facility.

Facility Director does not have lead training Certificate.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Based on LPAs records review the following violation was observed are being cited in accordance with Written Directives Section 101700.3 (b)(1) California Lead Action Level at Child Care Centers, is being cited on the attached LIC 809D.

The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00.

Exit interview conducted and report was reviewed with the Director, Sharon Alkin. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
