Licensing Program Analysts (LPAs) Giselle Lucero and Patricia Duron conducted an unannounced Case Management visit. LPAs met with Director Vanessa Stahl, to discuss the Lead Sampling Testing conducted on 03/29/2023. Director was advised on 04/02/2024 that the Lead Sample Report needs to be posted. LPAs confirmed Director had posted the Lead Sample Report. Census was taken a total of 6 staff and 59 children.
A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Facility was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires all licensed Child Care Centers (CCC’s) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five years after the date of the first test. Community Care Licensing was notified that lead water testing conducted at the facility on 03/29/2023 failed allowable limit for lead. The purpose of today’s visit is to follow up lead testing results of Action Level Exceedance (ALE) on outlet P,Q,S,N,K. In lab report outlet P result as 9.34 ppb, outlet Q result as 13.900 ppb, outlet S result as 34.800 ppb, outlet N result as 8.390 ppb, outlet K result as 6.27 ppb.
Director stated the outlet with high levels of Lead are inoperable or are not for consumption. LPAs observed outlet P and Q are drinking fountains located in the preschool play yards, permanently closed off. Outlet S is a drinking fountain located in the infant play yard, permanently closed off. Outlet K is a faucet located in the school age classroom. Director stated outlet is not used for consumption, LPAs observed a sign above the sink that states, “Hand washing only. Not for Consumption.” Outlet N is a faucet located in the kitchen. Director stated outlet is not used for consumption, LPAs observed a sign above the sink that states, “Hand washing only. Not for Consumption.” Director stated outlet M located in the kitchen is used for food preparation, which passed the lead test.
