On 12/19/2022, Licensing Program Analysts (LPAs) Dianna Valdez Santana and Patricia Duron conducted an in-person inspection to deliver the findings regarding the above complaint allegation. LPAa met with Director Vanessa Stahl. There was a total of 9 infants with 3 staff supervising and 9 toddler children with 3 staff supervising.
A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 09/21/2022, Licensing office received a complaint alleging the following: Staff are not preventing day care child from biting other day care children. Reporting Party (RP) stated a child was being bit by child #1 (C1) and staff was not doing enough to ensure the safety of the other children.
During the course of the investigation, LPA interviewed 5 staff and 5 parents. No child interviews were conducted due to being non-verbal.

During the staff interview, staff #1 (S1) stated the following: C1 was not the only child that bites; that there were 3 other children that the staff are working with that struggle with biting. There’s a parent who has complained that their child was being bit by another child a few times, but it wasn’t the same biter. They have two other biters in classroom #2 and one child has stopped biting. They are trying to do everything to prevent or manage the biting; such as, asking parent of the biters to send teething toys and to have teachers shadowing that child. They have received resources from their headquarters to help them manage biters. S3 stated they shadowed the biting child. Director stated the following: There are 4 biters in the classroom. They have been separated all the biters into four groups with a fully qualified teacher. Each teacher has their own activity schedules so the biters will not be together during the day. Staff used the ABC chart as a tool to assist staff in pinpointing times and possible patterns when the child is biting/attempting. The biting has slowed down; however, hasn’t stopped completely but staff have implemented systems in place to greatly reduce biting from happening.

LPA reviewed the children's files and obtained the following documents: staff and parent resources regarding children biting. Incident reports for the children that bite. Toddler Room 3 and 4 Class daily schedule. C1’s "Weekly Multiple Behavior Tracking Sheets since starting the new behavior plan. C1’s "ABC Chart" for September.

LPA contacted 9 parents and was able to interview 5 parents. All 5 parents are very happy with the program. None had any concerns or issues.

Based on the information gathered from LPAs' interviews and reviewing records, there is insufficient evidence to corroborate the allegations of staff are not preventing day care child from biting other day care children. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is unsubstantiated.

Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights was explained. A copy of appeal rights (LIC 9058 1/16) will be provided and the signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
