On 09/22/2023, Licensing Program Analyst (LPA) Romy Castanon made an unannounced visit to the facility to deliver findings of a complaint that was received at the Orange County Regional Child Care Program Office. LPA met with Director Vanessa Stahl and explained the reason for today’s visit. A tour of 4 infant classrooms was conducted and census was taken. Observed at the time of the visit was a total of 27 infants and 4 staff members.
A review of the Facility Personnel Report Summary on 09/22/2023 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 07/21/2023, the Regional Office received a complaint report alleging staff are not properly supervising daycare children. Complaint stated during a face painting event, Reporting Party (RP) received a photo and in the background is a teacher holding a phone up to the children. RP also mentioned upon morning drop off’s Classroom #3 has infants and toddlers of different ages. RP has also observed teachers with

their backs faced toward the children. RP did not include their contact information so LPA was unable to obtain further details.

During LPA’s initial visit on 07/28/2023, LPA interviewed Director, Assistant Director and 4 staff members. Director and Assistant Director informed LPA Room #3 is a morning opening room. Meaning, it is one of the first rooms that is open when the center opens at 6:30am. The infants and toddlers are in those classrooms having breakfast, then are transferred to their respective classrooms as teachers arrive. Teachers are allowed to have their cell phones on their person and in the classroom but not for personal use. Cell phones are used to communicate with parents through their electronic application. Teachers are also allowed to use their cell phones to play lullaby music during naptime. The screens are always to be placed face down. Director and Assistant Director each explained the constant supervision procedures including audial and visual. Staff are encouraged to provide supervision appropriate to the child’s age, needs and development. Each infant classroom is assigned two teachers. During LPA’s visits, LPA was able to observe two teachers with up to 8 infants in the classrooms.

During LPA’s interviews with 4 staff members, all 4 staff stated they provide constant supervision to the infants in their care. 2 out of 4 stated the infants’ safety is a priority. 2 out of 4 staff members stated cellphones are not allowed in classrooms. 2 out of 2 staff stated cell phones are allowed to be used in the classroom for nap music and to be able to occasionally check for notifications.

LPA attempted to interview 5 parents, but 3 parents were unavailable and did not return LPA’s call. 2 out of 2 parents provided positive feedback regarding the facility. Parents did not disclose any pertinent information related to the complaint allegation.

On 07/31/2023, Director conducted an all-staff meeting regarding “Technology in the Classroom ie: cell phones etc. and Child Supervision.” The Director submitted a signed attendance sheet for all staff, as well as documentation provided to staff that included licensing regulations.

Based on LPA’s interviews conducted with Director, Assistant Director and 4 staff members, the allegation staff is not properly supervising daycare children may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Exit interview was conducted with Director Vanessa Stahl. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights.
