Licensing Program Analysts (LPA) Giselle Lucero conducted a complaint investigation visit regarding the above complaint allegation. Upon arrival, LPA observed a total of 33 preschool children with 4 staff in the classrooms and 10 toddlers with 2 staff in the classroom.

A review of facility Personnel Report Summary on this date indicates that facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 04/07/2025 alleging the facility staff are not made aware of children's allergies. Reporting Party (RP) reported the facility does not have an allergy list available in the classrooms causing staff to be unaware of children's allergies.

During the complaint investigation, LPA Giselle Lucero interviewed staff, parents and conducted a physical plant inspection.

On 04/11/2025, LPA Lucero interviewed 5 staff. During staff interviews, it was disclosed that staff were not fully aware of children's specific allergies.

LPA conducted a physical plant inspection of the classrooms and only observed 1 out of 3 children's allergies posted in a classroom.

LPA interviewed 4 parents. Parents interviewed made no disclosures and expressed no concerns regarding the facility.

Based on the interviews conducted with staff, 4 parents, and physical plant inspection, it has been determined facility staff are not aware of children's allergies. Therefore, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, 101223 (a)(2) Personal Rights is being cited on the attached LIC 9099D.

Exit interview conducted and report was reviewed with the Director Deborah Warkentien. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.

The Department received a complaint on 04/07/2025 reporting (1) facility first aid kit is not accessible and (2) medication is not centrally stored. Reporting Party (RP) reported a child was injured on the playground and staff were not able to attend the child because the first aid kit is not easily accesbile to staff. RP also reported staff are not aware where children's medication is stored.

During the complaint investigation, LPA Giselle Lucero interviewed staff, parents and conducted a physical plant inspection.

On 04/11/2025, LPA Lucero interviewed 5 staff. During staff interviews, staff disclosed the first aid kit is stored in a top cabinet in the facility's kitchen. Staff stated if a child needs the first aid kit, they will take the injured child and a few other children with them as "helpers" to where the first aid kit is stored and will apply first aid. Staff stated they do this to ensure they are not out of ratio. Staff denied there ever being a time where staff did not attend to a child who needed the first aid kit due to staff preventing to be out of ratio. Staff stated they always apply first aid if needed. Staff also disclosed the children's medication is located by the first aid kit or in the Director's office. Staff stated if a child needs their medication or epi-pen, they will contact the Director.

LPA conducted a physical plant inspection and observed the first aid kit stored in a top cabinet in the facility's kitchen. LPA also observed the children's medication near the first aid kit.

LPA interviewed 4 parents. Parents interviewed made no disclosures and expressed no concerns regarding the facility.

Based on the interviews conducted with staff, 4 parents, and the physical plant inspection, it was determined there was insufficient evidence that (1) facility first aid kit is not accessible and (2) medication is not centrally stored. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated. Exit interview was conducted with Director Deborah Warkentien. Notice of Site Visit was posted during the visit.
