On 11/06/2023 Licensing Program Analysts (LPAs) Dianna Valdez Santana and Vivian Trinh made an unannounced visit to Kindercare Learning Center for the purpose to deliver findings of a complaint received. Upon arrival, LPAs were met by Director, Alycia Tucker. Director was explained the reason for today’s visit. LPAs were provided a tour of the facility and observed 13 Preschool Staff and 73 Preschool children present.
A review of the Facility Personnel Report Summary conducted on today’s date indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 08/25/2023 a complaint was filed with the Licensing office stating A daycare child who has lice was allowed to stay in the classroom and daycare children are being exposed to lice.
Reporting Party (RP) stated, at least one child has lice and is allowed to be in the classroom with other children. RP reported that Child #1 (C1) "for sure has lice" and "the lice are visible on the child's hair." C1's sibling, Child #2 (C2) possibly has lice too. Page 1 of 3

During the course of investigation, LPA interviewed 9 staff members and 2 parents and 6 children.
During the staff interviews, Staff 1 (S1) stated, the facility protocol when a child has lice is, that staff call the parent of the infected child and ask them to pick up the child and do treatment. The staff tell the parents to treat the child and make sure there isn’t anything alive before they return to school. Staff would then double check what rooms the child was in and start cleaning and laundering everything. Staff would also notify parents through the app. Staff would also check the other children. On August 3, 2023, a staff did discover that a child in Preschool B classroom had lice. The child was sent home and other children were checked. A letter was sent to parents on the app notifying them and staff were instructed to check other children and launder and sanitize everything in the classrooms. Staff 2 (S2) said When a child is found to have lice, they are sent to the office, the child gets checked for the lice and then get sent home. Staff then launder everything, and staff clean and sanitize and spray everything down and vacuum. Then the admin send a letter letting parents know. One child got lice in the summer and their parents took them home that same day. As far as S2 knows no other parents reported their child contracting lice from the one child at the facility. Staff 3 (S3) disclosed the procedure for lice is, the facility send the child/children home and staff clean up the rooms and do all the sanitizing and all that. As far as a child recently having lice, S3 stated, a child from the infant classroom was sent home out of precaution. As far as S3 knows, that child did not have it but because S3’s student’s sibling had lice, it was decided that the siblings be sent home as well.

Staff 4 (S4) says, “It is S4’s understanding the procedure for lice is that the infected child immediately gets sent home and parents/staff are notified. Staff then launder and bag everything and disinfect everything. Sometime in August a sibling of my student’s had gotten lice. Out of precaution my student and the other sibling were sent home as well.” S4 did not hear of any other children getting lice and does not feel any other children were exposed because S4’s student did not get it even though S4’s student’s sibling did. Staff 5 (S5) disclosed that staff were told that a child cannot be sent home unless there are live lice. Then the staff send a notice to the parents notifying them of the incident. Staff then wash all the soft toys, blankets and clean extra. S5 said there were 3 children that had gotten lice and they were sent home. One of the siblings was brought back to school but S5 saw one live lice so the child was sent back home. Staff 6 (S6) said S6 heard a child had gotten lice but it was not in S6’s room. S6 said parents were notified right away on the app. S6 does not think the other children were exposed because the child was sent up to the office right away and then sent home. Also, no other parents reported other children had gotten lice. Staff 7 (S7) disclosed that when a child gets lice, the child gets sent home, parents are notified and told treat them and not return until there is no more live lice. Page 2 of 3

Then staff take off the sheets, wash and cleaning everything. Staff 10 (S10) stated, staff were told that staff cannot send the infected (with lice) children home unless they have live lice.

The administration send a notice to the parents notifying them of the lice. Staff wash all the soft toys, blankets and cleaned extra. S10 thinks children were exposed to lice in S10’s room since one of the children had one live lice. S10 stated S3 discovered live lice on a second child (Child #2, C2) was sent home. LPA asked S3 if S3 had see any lice on C2 and S3 denied seeing any lice, alive or dead on the child. S3 stated only C1 had lice and was sent home immediately.

LPA received a copy of the letter that was emailed to parents notifying them of the lice incident and the post that was sent on the KinderCare app. LPA also verified staff timecards and student sign in/out sheets to verify that the infected child was sent home and was home for at least 3 days.

LPA interviewed 6 children and 4 out of 6 denied seeing other children in their class excessively scratching their heads.

LPA contacted 4 parents and 2 out of 4 parents had no issues or concerns with the daycare.



Based on the information gathered from LPAs’ interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of A daycare who has lice was allowed to stay in the classroom and Daycare children are being exposed to lice. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED.

Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
