32 | On 6/24/25 the Orange County Child Care Office received a complaint alleging (1) Unqualified staff is providing care and supervision (2) Staff do not provide healthful accommodations for the daycare children (3) Staff are not meeting the medical needs of a daycare child. Reporting Party (RP) stated the following: Staff#11 (S11) is in the infant/toddler classroom without the required infant units. S11 is alone in the nap room with the infants. Classrooms remain consistently unsanitary. The toys are visibly dirty, rarely sanitized, and mouthed toys are not immediately removed for cleaning as required. There are frequent substitute teachers that are not made aware of child’s severe, life-threatening allergies or of the proper policies and procedures regarding the use and storage of the child’s Epi Pen, posing serious health risk.
During the investigation, LPA toured the facility, reviewed 11 staff files, and obtained copies of the children’s roster and personnel report. LPA also conducted interviews with 12 staff members and 3 parents.
Regarding allegation: (1) Unqualified staff is providing care and supervision
During staff interviews, all interviewed staff members stated S11 is not alone with the infants in the classrooms. Staff members stated they don’t always use S11 to break staff members for their lunch/breaks as they are able to break themselves if ratio permits them. S11 stated the following: S11 does not have infant units but is not alone with the infants when the infants are awake. During naptime, Staff #11 (S11) is in the nap room with the infants while they are asleep, while a qualified staff member remains in the infant classroom. If an infant wakes up in the nap room, S11 will call a staff member from the infant classroom for support. LPA reviewed S11 staff file and confirmed that S11 does not have infant units.
Regarding allegation: (2) Staff do not provide healthful accommodation for the daycare children
During staff interviews, 11 staff members stated the classroom toys are cleaned every day by the staff members. The small toys are put in the dishwasher and the large toys are put in the Zono machine where the toys get sanitized. Staff members also stated that when toys are mouthed, they are put in a dirty basket so they can be washed. On 6/30/25, LPA observed the infant classroom toys and did not observe any concerns.
