RP stated Staff #4 (S4) walked past the incident and did not interfere in the incident.
During the investigation LPA Lucero interviewed 4 staff members, 4 children, 5 parents, and reviewed the children’s roster.
During the investigation on 10/02/2023, LPA Lucero interviewed 4 staff. 4 out of 4 staff stated they have not observed staff yelling or handle a child in a rough manner. Staff #4 (S4) disclosed staff do not yell at the children but sometimes staff talk firmly to children.
On 10/02/2023, LPA Lucero interviewed 4 children. Child #1 (C1) stated staff do not yell at children or has never seen a teacher grab another child in a rough manner. Child #2 (C2) disclosed observing S4 yell at a child telling the child to go back to their desk and grabbing the child in a rough manner. Child #3 (C3) disclosed observing Staff #3 (S3) yelling at a child. C3 declined observing a staff grab children in a rough manner. Child #4 (C4) disclosed observing a staff yell at a child. C4 declined observing a staff grab children in a rough manner.
On 10/23/2023 LPA attempted to interview 7 parents, however only 5 parents were available for interview. All of the parents interviewed are satisfied with the childcare facility, and do not have any concerns.
Based on LPA’s interviews conducted with 4 staff, 4 children, and 5 parents, it has been determined (1) staff handle day care child in a rough manner and (2) staff yell at day care children. Therefore, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, Title 22, 101223 (a)(3) Personal Rights is being cited on the attached LIC 9099D.
