32 | During the staff interview, 10 out of 9 staff stated facility is out of ratio in the morning due to lack of coverage. Staff 2 stated facility is out of ratio, 2 or 3 times week. In the morning and the afternoon because teachers are leaving in the afternoon, and in the morning it’s because we are waiting for staff to arrive.
On 8/2/2023 at 7:10 am, LPA Duron arrived at facility and observed classrooms in ratio. LPA reviewed Child Supervision Record (CSR) and confirmed that in preschool classroom at 8:37am, staff documented 14 children in care with 1 staff present.
Children interviews were conducted, and no disclosure was made.
LPA Duron interviewed 3 parents. All interviewed parents stated they did not have any concern with facility.
Based on LPA’s interviews, observations and reviewing records, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101216.3 Teacher-Child Ratio (a)There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. Please refer to attached 9099D for documentation of deficiencies.
LPA Patricia Duron informed Director that this report date 8/2/23 document(s) one Type A citation which shall
be posted for 30 consecutive days as there are immediate risk(s) to the health, safety, or personal rights of
children in care.
LPA Patricia Duron informed the Director, Jennifer Patterson to provide a copy of this licensing report dated
8//2/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the
next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.
The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Page 2 of 2. End of Report. |
