On 03/18/2026, Licensing Program Analyst (LPA), K. Navar conducted an unannounced complaint inspection for the purpose of delivering findings. This is a continuation of a complaint inspection initiated on 01/26/2026. Upon arrival LPA met with Licensee Mina De La Torre and was led on a tour of the facility both inside and outside. During inspection LPA took census and observed a total of 5 children/ 1 infant in care.

A review of the Facility Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios.

On 01/22/2026, the Orange County Child Care Office received a complaint alleging: (1) Licensee did not meet a day care child's diapering needs, resulting in the child sustaining diaper rash. (2) Licensee did not prevent an infant in care from contracting ringworm. Reporting Party (RP) stated that Child #1 (C1) had got ring worm in the facility and a diaper rash because C1’s diaper was not changed often enough in the facility.

During the investigation, LPA toured the day care home on 01/26/2026 and conducted 2 (two) staff interviews, obtained a copy of Child Care Roster Facility Roster, written email, 2 (two) Ring Video Recording dated Friday 01/09/2026 and Monday 01/12/2026, and a blank Infant Daily Report. Infant/Children had limited vocabulary and did not qualify to be interviewed.

Regarding allegation (1) Licensee did not meet a day care child's diapering needs, resulting in the child sustaining diaper rash. On 01/26/2026 LPA Navar conducted an unannounced inspection at the family childcare home and met with Licensee Mina. During facility tour LPA observed the bedroom next to the front door to have a diaper changing table and cubbies that stored infant and children’s supplies such as diapers and wipes labeled with their names. LPA conducted 2 (two) staff (S1-S2) interviews for 2 (two) staff present who stated that they are aware of a concern regarding a rash on C1 in the diaper area and that S1 had a conversation with parent 1 (P1) regarding the diaper rash. S1 stated on date 01/09/2026, P1 dropped off C1 and about 30 minutes after dropping off, S1 changed C1’s diaper and noticed the diaper rash. P1 did not provide S1 any diaper cream to apply on C1. 2 (two) staff interviewed stated that parents bring the diapers, wipes, and ointment from home and that children’s diapers are checked every 2 (two) hours and changed when needed. 1 (one) staff interviewed stated that they keep track of diaper changes by documenting them on an Infant Daily Report and when diapers are low that they will converse with the parents to bring more. LPA observed 1 completed Infant Daily Report that documented information such as the infant’s name, date, mood, diaper change time and type/details, feeding times and details, food type, time, and amount, favorite activities, and notes, and a list of items to bring with a box to check.

Regarding allegation (2) Licensee did not prevent an infant in care from contracting ringworm: During unannounced family childcare inspection on 01/26/2026, LPA toured the home with licensee Mina and observed the family childcare home to be kept clean and orderly, with heating and ventilation for safety and comfort. LPA conducted 2 (two) staff interviews (S1-S2) and 1 (one) of 2 (two) staff interviewed stated that they have heard of a concern regarding a child C1 having ringworm on their forearm and that a conversation had taken place with parent 1 (P1). S1 stated a while ago in December, S1 had mentioned to P1 that there was a red patch on C1’s forearm and that P1 had never requested for S1 to put any cream on the rash. S1 stated that P1 had mentioned they would put the cream on at home. About 10 days later, P1 took C1 to the doctors and that the doctor confirmed it was ring worm. The ringworm had cleared up by 1/23/2026. S1 stated that no other children enrolled in the family childcare program had been observed to have ringworm or no one reported their child having ringworm and that this was an isolated incident.

During parent interviews. LPA called five (5) parents, and LPA was able to interview 2 (two) parents. The 2 (two) interviewed parents did not divulge any information pertaining to the allegations (1) and (2).

Based on LPA observations, interviews, and records review; the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not preponderance of evidence to prove the alleged violations of (1) Licensee did not meet a day care child's diapering needs, resulting in the child sustaining diaper rash. (2) Licensee did not prevent an infant in care from contracting ringworm. Therefore, the allegations are UNSUBSTANTIATED.

Exit interview conducted and report was reviewed with Licensee Mina De La Torre. The Licensee was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
