RP did not know the exact number of children or their ages but stated the Licensee usually cares for 6 toddlers and 3 infants. RP stated Child #1 (C1) is often isolated and alone in the playpen/play area through photos and videos sent by Licensee. RP stated they have also observed Licensee leave the facility to pick up children or run errands. RP also mentioned Licensee has one assistant.
During LPA’s initial visit on 09/15/2023, LPA interviewed Licensee. Licensee stated they leave every day at 7:45am and 2:40pm to pick up their children from school. The trips are about 10 minutes. LPA mapped the distance of the school which is about 1 mile away. The Licensee states they leave the daycare children in the care of A1 when they are away from the facility. The licensee denied C1 being isolated in a playpen as they have a matted infant play area. The licensee stated when C1 would not nap during the facility rest period, they would move them to the play area not to disturb the napping children. Licensee stated, she or the Assistant would continue caring for the child, so C1 and the napping children were never left alone.
LPA interviewed Assistant #1 (A1) who works the same hours the facility is open; 7:00am-5:30pm. A1 stated they are always observant of the children especially during activities. A1 stated they follow their schedule and switch with Licensee often for support. A1 provides supervision and cares for the daycare children when Licensee leaves the facility.
LPA contacted 5 parents for an interview. 3 out of 5 parents did not disclose any information pertinent to the complaint allegations.
LPA attempted to interview two children at the facility but were not qualified due to their age and language development.
Based on LPA’s interviews with Reparting Party, Licensee and Assistant the allegation staff left day care children unattended may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.
Exit interview was conducted with Licensee Emilia Montano. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. Licensee was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. (End of Report)
