On 12/3/24, Licensing Program Analyst (LPA) Silva conducted a case management – licensee initiated visit to increase the family child care home (FCCH) capacity from a small to a large license. LPA met with licensee Yorlady Moreno and Ana Leon. Yorlady provided a tour of the facility. Licensee stated there are four adults and one minor living in the home. Licensee stated she is not currently registered with any Foster Care agency or holds a foster parent license. Licensee was reminded if changes are made to notify the licensing office. Facility Day care hours are 6:00 AM - 6:00 PM, Monday through Saturday. The census at the time of the visit was 7 daycare children.

A review of the Facility Personnel Report Summary on this date indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

All areas on the Facility Sketch LIC 999 were inspected including off-limits areas. The facility is a 2-story home with 5 bedrooms, 3 bathrooms, 1 living room, a family room, a kitchen, dining room, a front yard (not fenced), a backyard (fenced), and a garage. There is a fireplace, located in the family room, barricaded by a wooden toy case. There is a gate at the bottom of the stairs making the stairs inaccessible to daycare children. The licensee was reminded to ensure the stairs are inaccessible and the gate is locked.

The garage will not be used for daycare. The licensee stated the garage is an off-limit area. The licensee acknowledged daycare children may not enter the off-limit areas during operation hours. The areas off-limits to children and parents are as follows: All the second floor plus the garage, and kitchen. The applicant has placed child-proof safety gates at the entrance of the stairs and the kitchen to ensure inaccessibility. The applicant has a child-lock on the door of the garage ensuring this area is inaccessible to the children in care. The applicant understands that licensing staff may have access to off-limits areas during inspection visits if necessary.

Areas Designated for Day Care Activities: The applicant has designated the living room, family room, dining room, first floor bathroom, and back yard (excluding the side patio entrance hallways as shown in the LIC999) are used for daycare activities.

Detergents, cleaning compounds, medicines, sharp objects, and hazardous items that can pose a danger to children are inaccessible in areas designated for children. The applicant stated that there are no poisons on the premises and LPA did not observe any. The applicant was advised that any poisons must be locked with a key or combination lock. The applicant stated that there are no weapons or firearms on the premises. The LPA informed the applicant that when firearms are present, they must be locked and stored separately from the ammunition per CCR 102417(g)(4)(C).

The pressure gauge on the 2A-10BC fire extinguisher(s) indicates fully charged, as indicated on the service tag observed. Smoke and carbon monoxide detectors were tested and are operable. The fire extinguisher type 2A-10BC must be serviced annually or as often as necessary. It was last reviewed on 09/18/2024. Smoke and carbon monoxide detectors should be checked, and batteries replaced as needed. The fire alarm required by the fire department is located in the living room at the bottom of the stairs.

Outdoor play activities will be conducted in the backyard. The backyard is appropriately fenced. Licensee states that she will be supervising children during all outdoor play activity. LPA observed age-appropriate play equipment to be free from hazards. There are no bodies of water on the premises.

A records review indicates the applicant completed the required Health and Safety Training with Nutrition and Lead Poisoning components. The applicant has a current Pediatric First Aid and CPR certification that expires on 1/21/2025.

In the absence of the licensee, a qualified adult must be present to supervise the children—a qualified adult is an individual who has a valid and current Pediatric First Aid and CPR certification, TB clearance and immunization, and valid criminal record clearance that is associated with the licensed facility. Annual fees must be paid by the due date, or a late fee shall be assessed and/or the License may be terminated. The licensee was reminded that all licensees must be present at least 80 percent the hours of operation per day.

The licensee has a current roster of children in care. LPA reviewed 7 children’s records, which were in compliance.

H&S 1597.622: Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. The applicant has submitted proof of immunizations.

Health and Safety Code 1596.7995: Beginning January 1, 2018, all licensed providers, applicants, directors, and employees must complete training as specified on mandated reporter duties. Training is available at www.mandatedreporterca.com. The applicant has completed the required mandated reporter training. Recertification is required every two years.

Safe Sleep - Family Child Care Homes. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at:

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. Licensee stated she is not currently administering medication. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Family Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Fire clearance granted on 11/12/24

During todays’ inspection, there were no deficiencies cited and licensee was in compliance with California Code of Regulations Title 22 for operating a Family Child Care home.

A new license for operating a Large Family Child Care Home shall be issued upon final review. In the event additional requirements are needed, the applicant will be notified. A license will be issued once all requirements are met.

Exit interview conducted and report was reviewed with the licensee, Yorlady Moreno. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

During the exit interview, the licensees Yorlady Moreno confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
