The Complaint received on 03/23/2021 alleged that the facility was operating out of ratio. During the Initial 10 Day Tele-Inspection, LPA Corral requested a Copy of the Children’s Roster, along with sign-in and sign-out sheets. On 04/07/2021 Director emailed LPA Corral infant sign-in and sign-out sheets from 03/15/2021 – 03/26/2021. The documents received show 5 infants being signed in four out of the ten days reviewed. The dates where 5 infants were signed in were from Monday, 03/15/2021 – Thursday, 03/18/2021. LPA Corral conducted Staff Interviews on 04/02/2021 and 04/21/2021. During the interviews 2 Staff members disclosed that they observed 5 infants present in the infant room in March 2021, one Staff member stated 5 infants were present in care for 1 to 2 weeks in March 2021. The other staff stated the infant room was over ratio the last weeks of March 2021. Director Deepika also provided LPA Corral with a Correction Letter stating that the infant to teacher ratio issue was corrected to follow the Child Care Regulation of four infants to one teacher.
Based on the Record Review LPA Corral conducted and the information that was obtained from the interviews with the 2 Staff members, LPA Corral was able to confirm that the Facility was out ratio in the Infant Room, the preponderance of evidence standard has been met, therefore the allegation regarding the facility operating out of ratio is found to be Substantiated. This constitutes a violation of operation of Title 22, California Code of Regulations, 101416.5(b) Staff-Infant Ratio, which states there shall be a ratio of one teacher for every four infants in attendance. This allegation is being cited on the attached LIC9099D.
A Type A violation is being cited today therefore the facility must post and provide copies of the report to Parents/Guardians of the children in care by the next business day. Facility shall also provide a copy of the Report to the Parents/Guardians of children newly enrolled in the facility for the next 12 months. The facility is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. In addition, the facility shall immediately post upon receipt the Proof of Correction for 30 consecutive days. LPA Corral reviewed Staff Infant Ratio Title 22 Regulation with Director and advised Director to review these Regulations with Staff.
Exit interview was conducted and report was read to Director Deepika Wijegunaratne via Tele-Inspection. A copy of the Investigation Report along with Appeal Rights will be email to Director with a Read Receipt requested to acknowledge report was received. Director was asked to respond to email by copying and pasting “I have read and received the Report and Appeal Rights, I acknowledge receipt." Appeal Rights were explained. Licensee was informed first level of appeal is directed to Regional Manager to the address listed above. Notice of Site Visit was not posted due to Tele-Investigation COVID-19 State of Emergency.
