Licensing Program Analyst (LPA), Mila Quinto conducted investigation visit to the facility to deliver the findings. LPA met with Director, Charity Smith. The Covid-19 Emergency Response questionnaire was reviewed and answered by the director. Census was taken. There was a total of 48 preschool children with 5 staff in different classrooms.

A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The complainant alleged facility is not following incident reporting requirements.

On 1/18/22 and 3/8/22, LPA interviewed 4 staff members including the director and 10 preschool children. According to the director, incident reports are done when there is an event happened that is not normal. When a child is injured with visible marks, anything related to head, an incident report is created and given to the parent. Director stated, for minor injuries, staff will inform the parents verbally during pick up. All staff stated when a child gets injured, they write an incident report and give to the director for approval. The incident report is created even for minor injuries. The staff will also inform the parents during pick up of the incident report. LPA reviewed 5 children’s files for sample of incident reports and appear to be in compliance. According to the Director, incident reports are given to the parents and keep a copy in children’s file. There were no disclosures from the 10 children interviewed. On 1/25/22, LPA called 9 parents of which 4 of the 9 were interviewed. There were no disclosures from the 4 parents. LPA did not receive a call back from the 5 parents.

This agency has investigated the complaint alleging facility is not following incident reporting requirements. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.
