Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted a follow up investigation regarding the above allegations. This is a follow up for the visit conducted on 5/7/2024. LPA met with assistant director, Marlo Enriques. The director Maryjoy Hilsabeck arrived during LPA's inspection. Census was taken. There was a total of 17 infants and toddlers with 5 staff in two different rooms. There were 7 infants with 2 staff in infant room 1, and there were 10 toddlers with 3 staff in toddler room. Infant Room 2 was not in use.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 5/2/2024, the Orange County Child Care Office received a complaint alleging “facility staff do not isolate children with clear signs of illness”, facility staff do not keep classroom clean and sanitary”, facility staff do

not keep facility free of odor”, and facility staff do not provide a comfortable room temperature for day care children . Reporting Party (RP) stated it was observed child # 1 with pink eye and the child’s parent was not notified. Child # 1 was not isolated. The classroom did not appear to be sanitized or cleaned thereafter. R/P stated child # 1 returned after two days and observed another child with pink eye. The RP states the trash can with dirty diapers is malodorous. The RP states blue carpets are not regularly cleaned and toys in the classroom are not disinfected. The RP states the room is warm and uncomfortable to be in with the temperature.

During the course of investigation, LPA interviewed 8 staff working in infant/toddler classrooms and contacted 10 parents of whom one parent responded.

Regarding the allegation of “Facility staff do not isolate children with clear signs of illness”, staff stated: If a child has fever or pink eye, parent will be notified by phone call or through the Sprout About Application to come and pick up the sick child. Staff stated they hold the sick child until parent picks up the child or send the child in a buggy to the director’s office. Staff stated, Child # 1 was picked up by the child’s parent when they called the parent last week. The school was notified the child had ear infection. The child came back after one day staying home with no fever. Another staff stated child # 1 had crusty eyes, runny nose and no fever. Parent was called so the child to be picked up. Staff stated the child was isolated by staff holding child # 1 separate from others. One staff stated sometimes the sick child stays in the office. One staff stated if they see signs of illness in a child, they take child’s temperature. They keep the sick child in the front office if child has fever. One staff stated they don't let them come if they don't have doctor's note. It depends on the seriousness of the sickness. Another staff stated they keep the sick child with fever next to the staff until the sick child is picked up. Another staff stated they observed child # 2 had some discharges in the eyes. (unknown date). Child was picked up and did not come the next day. Another staff stated child # 2 had eye discharges. (unknown date). Child stayed home the next day. Staff observed the child when back to school having clear eyes. They think child had ear infection. Another staff stated when they have a sick child, they let the child sit at a different table or in director's office until child is picked up. LPA reviewed the sign in/out sheet which showed child # 1 was picked up on 4/23/2024 at 1:25 pm and did not attend the next day. LPA

reviewed the written conversation between the staff and parent which was confirmed child # 1 did not have pink eye.

Regarding the allegation of “Facility staff do not keep classroom clean and sanitary”, staff stated they have a bucket in the classroom for mouth toys to be sanitized every day. One staff stated they sanitize the toys and equipment to make sure children’s classrooms are clean and sanitary. One staff stated they have responsibilities after work as far as keeping their classrooms clean and sanitized. One staff stated the janitors shampoo the carpet. They place clean area rugs on the carpet. Another staff stated the carpets in the classrooms are vacuumed every day and they are clean. They might be old but not dirty. One staff stated the carpet is clean and they replace them when they are dirty. Staff stated they sanitize the toys, equipment, and the classroom throughout the day and at the end of the day. LPA observed a container in the toddler room with a written stating “mouth toys”.

Regarding the allegation of “facility staff do not keep facility free of odor”, Staff stated the rooms do not smell. They stated they put the dirty diapers in a plastic bag, tie the plastic bag, and place it in the trash bag inside an airtight trash can, and they empty them in the dumpster throughout the day as needed. Another staff stated they have a trash can just for diapers and another trash can for regular trash. Staff stated they have not smelled anything bad. They also use air freshener in the classrooms. LPA observed the trash cans in the room with airtight lid and air freshener mounted on the wall.

Regarding the allegation of “facility staff do not provide a comfortable room temperature for day care children", staff stated the temperature in the room has never gone under 68F or more than 85F. The staff stated the thermostat needs to be adjusted as needed because the thermostat in the 2-year-old room is shared with the toddler room. Each time the toddler room gets hot, somebody needs to adjust the thermostat in the 2-year-old room to get a cooler air in the toddler room. One staff stated their room gets too hot and the facility cannot do anything about it. They have tried to fix it but not fixed permanently. One staff stated when the room gets hot, it takes 30 minutes the cool air to kick in after adjusting the thermostat. One staff stated, the thermostat goes to 72 by itself and we change it to 70F, but it does not go under 68F or above 85F. One staff stated they notify the office when their room gets hot. temperature is comfortable. Some people say it is hot, but it is not hot. They think it might be due to staff running around. Another staff stated the toddler room gets too hot. However, winter days are fine. It shots down at 72F. Another staff stated room temperature is fine, but it depends to the sensitivity of individuals to
hot and cold atmosphere. LPA checked the thermostat on the day of inspection and observed the thermostat in the 2 year old room showed 71F.

During the course of interviews with eight staff, and 10 parents of whom one responded with positive feedback, and discrepancies among staffs' statements, there is not enough proof or evidence to support the above allegations occurred or did not occur. This agency has investigated the complaint alleging “facility staff do not isolate children with clear signs of illness”, facility staff do not keep classroom clean and sanitary”, facility staff do not keep facility free of odor”, and facility staff do not provide a comfortable room temperature for day care children”; although the allegations may have happened or are valid, there is not a preponderance of evidence to prove, the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Notice of Site Visit was posted. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.

In the areas which were investigated, no deficiency was cited today. The director, Maryjoy Hilsabeck was provided a copy of their appeal rights (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights.
