Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 7/9/24. LPA met with director, Jennifer Gardea and informed director of the purpose of the visit. The licensee guided LPA on a tour of the facility and a census was taken. The overall census observed was 11 staff and 38 children.
A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 7/1/2024 a complaint was filed with the Licensing office alleging management did not follow up and communicate with staff to provide adequate hygiene and care to child. Reporting Party (RP) stated on June 27th RP had a conversation with Director regarding staff providing extra diaper changes because child had a rash and director did not follow up and communicate with staff to provide extra diaper changes.

During the course of investigation, LPA interviewed 5 staff members, 4 parents, and reviewed records. No children interviews were conducted due to children’s age and being nonverbal.

LPA interviewed 5 staff members. Staff 1 (S1) stated, when child gets dropped off staff check them to see if they are wet. Staff check them every 2 hours. Unless they have a Bowel Movement (BM) or are wet staff change them before the two hours. Staff change them every time staff notice they are wet or have bowel movements. S2 stated, “The director will let us know if the parent requests an extra diaper changed. If the parent asks staff, we let parent know to talk to the director first about it. I believe they are charged a fee too. Staff check every two hours. If child is wet or have a bowel movement, staff changes the child right away before the two hours. S4 stated, the diaper policy is every two hours. Tutor time provides diapers and wipes for each child, Cuties and Care is a diapering supply program which is used by Tutor Time. Staff follows schedule of every two hours when child arrives, and they check throughout the day. If a child is wet or has a Bowel Movement, staff will change the child right way before the two-hour check. If a parent requests an hourly diaper change, they are charged a fee which is added to their monthly tuition. S5 stated, staff change children every 2 hours or as needed. For example, if a child is changed and they have a bowel movement 30 minutes later, staff will change the child, they do not wait for the two-hour check, it is as needed or when necessary. S5 stated, if a parent requests extra diaper changes they are charged an extra $9.00, which is added to their tuition.

LPA reviewed Diaper Log on Sprout About for Child #1 (C1). LPA observed diaper log on Friday 6/28/24, diaper was changed multiple times throughout the day. The morning schedule C1’s diaper was changed at 7:39am, 9:42am, 11:32am. After Nap time, during the afternoon schedule C1’s diaper was changed at 3:00pm, 4:16pm, and 4:40pm.

LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concerns with facility.

Based on the information gathered from LPAs’ interviews, observation, and the reviewing of records, there is insufficient evidence to corroborate the allegations: management did not follow up and communicate with staff to provide adequate hygiene and care to child. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegation is UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be
immediately reported to the Department.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice
of Site Visit” must be posted on or adjacent to the door.
