Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced visit due to a self-report Unusual Incident Report (UIR) received on 3/14/25. The UIR stated on 3/14/25 4 infant age children were left unsupervised in the classroom. LPA met with Director, and informed the director of the purpose of the visit.
LPA and Director toured of the facility was conducted, and a census was taken. Observed at the time of the visit was a total 29 infant children with 10 staff. A review of the Facility Personnel Report Summary indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On initial visit, 3/24/25, LPA interviewed 5 staff. LPA also inspected the classroom where Child #1 (C1), Child #2 (C2), Child #3 (C3) and Child #4 (C4) were left unsupervised. LPA was unable to interview children due to children’s age and being non-verbal.

During the interview, the Director stated on 3/14/25, C1, C2, C3, and C4 were left unsupervised in Toddler 2 classroom. Director interviewed staff from Toddler 1 and Toddler 2 and gathered information through interviews. S4 stated, they were in the patio area between Toddler 1 classroom and Toddler 2 classroom, S4 stated they noticed C1, C2, C3 and C4 standing at the sliding door. S4 stated they opened the sliding door and said hello, S4 stated there was no answer and S4 noticed there was no staff member in Toddler 2 classroom. S4 stated they left the patio area and went into the Toddler 2 classroom with their children to provide supervision to C1, C2, C3, and C4. S5 stated they were in the laundry room during this time which is between Toddler 1 and Toddler 2 classroom, S5 walked into Toddler 2 classroom with S4 and remained in the classroom as S2 and S6 entered the classroom.

LPA reviewed Face to Name Transition Sheet for March 14, 2025, and observed S2 clocking out of Toddler 2 classroom at 3:20pm and clocked in at 3:32pm. LPA observed S4 clocked in Toddler 2 classroom at 3:30pm, S4 stated they observed C1, C2, C3, and C4 after they clocked in and went into the patio area. According LPA's interviews and record review, children were left unsupervised for approximately 10 minutes. Page 1 of 2.

Director immediately met with S1 and S2 and verbally discussed the importance of signing in on Face-to- Name transition sheet, especially when a staff member is leaving the classroom or breaking a staff member. Director stated, staff will only be entering and exiting the classroom from front door and staff were reminded to sign in and out on Face to Name transition sheet when leaving the classroom and when staying in the classroom. Director stated, an all-staff training will be conducted on Saturday April 26, 2025, which management will discuss the importance of supervision, transitions, face to name, head count, and verbally communicate with one another during transitions.

Based on self-reported incident, and information gathered from LPA’s interviews and record review, it was determined the facility failed to provide visual supervision of a child in care, therefore, California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101229(a)(1) Responsibility for Providing Care and Supervision is being cited on attached LIC 9099D.

LPA Duron informed Director, Jennifer Gardea that this report dated 3/24/2025 documents one type A citation. Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

LPA Duron informed the Director, Jennifer Gardea to provide a copy of this licensing report dated 3/24/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview was conducted. Notice of Site Visit was posted during the inspection. Facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights LIC 9058 and their signature on this form acknowledges receipt of these rights.
