Regarding allegation (1) Staff used an unusual form of punishment on a child.
During interviews five (5) out of five (5) staff members stated that they have not observed a staff member that violated a child’s personal rights and that Child four (C4) did not complain of pain or discomfort to any staff on the day of the alleged incident. LPA collected documentation and reviewed the Employee handbook discipline policy. The discipline policy found in the employee handbook states that employees are to redirect children in care to a different activity. The Director stated that positive reinforcement is used and that children in care are not to be violated of their boundaries.
Regarding allegation (2) Staff did not report incident to appropriate parties.
During interviews five (5) out of five (5) staff stated that they are not aware of an incident that was not reported to the authorized representative. LPA collected and reviewed documentation of incident reports for C4. The Accidents and Injury section in the employee handbook states that if a child gets injured, staff are required to complete an ouch report for the child and give first aid care if needed. The Director stated that injuries are reported to parents on the same date of occurrence.
The Orange County Regional Child Care Licensing Office investigated the complaints alleging (1) Staff used an unusual form of punishment on a child; (2) Staff did not report incident to appropriate parties. Although the allegations may have happened or are valid, based on interviews and record reviews conducted, there was not a preponderance to prove that the allegations did or did not occur, therefore, the allegations are found to be UNSUBSTANTIATED.
No deficiencies cited. A notice of site visit was given and must remain posted for 30 days.
