32 | During investigation, LPA conducted observations on the interactions between facility staff and children in care during naptime and playtime on 04/02/2025, 05/13/2025 and 06/17/2025. LPA interviewed eight (8) staff, contacted twelve (12) parents, but only six (6) responded and were interviewed. LPA attempted to conduct nine (9) child interviews, but only five (5) children were eligible to be interviewed. During record review, LPA obtained Child Protective Services (CPS) report. Record review reveals that it was taken as information only.
Regarding allegation (1) Day care child was sexually abused by an unknown individual. LPA observed only female staff engage with and care for children. All eight (8) interviewed staff provided consistent statements about only criminal background checks cleared female staff engage with and care for children at the facility. All four (4) interviewed parents did not disclose any concerns regarding the allegation regarding an unknown individual. The five (5) interviewed children did not disclose anything to support the allegation. During observations, LPA did not witness any unknown male adult at the facility. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
The Orange County Regional Child Care Licensing Office has investigated the complaint alleging that (1) Day care child was sexually abused by an unknown individual. Based on the information gathered from LPA’s interviews, observations and record reviews, although the allegations may have happened or is valid, there was not a preponderance of evidence to prove the alleged allegations: (1) Day care child was sexually abused by an unknown individual did or did not occur, therefore the allegations are unsubstantiated.
A notice of site visit was given and must remain posted for 30 days.
