Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 10/29/24, LPA met with Director, Amy Diaz and informed the director of the purpose of the visit. The director and LPA observed classrooms and census was taken. The overall census observed was 5 staff and 28 children.
A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 10/24/24 a complaint was filed with the Licensing office alleging (1) Day care child sustained injury due to staff neglect, (2) Staff used an inappropriate form of punishment for day care child, (3) Staff are not supervising day care children in the bathroom, (4) Staff yelled at day care child, (5) Staff makes inappropriate comments towards day care children, (6) Staff did not ensure day care children listened to appropriate music, (7) Staff did not ensure day care child ate, and (8) Staff are not meeting day care child's needs. Reporting Party (RP) stated the following: a child received bite marks from another child. Staff put a child in the bathroom crying for ten minutes and kept yelling at the child to turn the light off. Staff didn’t take or supervise the children while they were in the bathroom. Staff called the children names like, “Hey green boogers”. Staff played inappropriate music (about LA gangs) to children. Staff ignored and left child’s shoes untied. A child was offered a sandwich for lunch and the child did not eat the sandwich, staff did not offer nothing else.

During the course of investigation, LPA interviewed 6 staff members, 4 children and 4 parents, and reviewed records.

Regarding allegations (1) Day care child sustained injury due to staff neglect

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed a day care child sustain an injury due to staff neglect. Staff #1 (S1) stated, staff will ask the child what happened? Do you want help? Do you want a hug? If another child hurts them, staff encourage them to use their words, staff will help them with their words, and have them express themselves to communicate. Even if staff don’t see a mark, staff will still give a courtesy call, and always give a note to the parent. Staff always have that documentation for parents to read and sign and staff file document away. Staff #6 (S6) stated, Staff will fill out an ouch report, with detail and description of the incident. If it is a not a major injury, staff will send a text informing parent about injury and staff document on an ouch report. If the injury is more serious, for example a child bumps their head, or there is an injury from a bee sting, staff have a phone call with the parent. S6 will suggest taking the child to go to the doctor to get checked out.

Regarding allegations (2) Staff used an inappropriate form of punishment for day care child

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed staff use an inappropriate form of punishment for day care child. S1 gave example, if a child bites, staff will go to their level, staff talk to the child, staff talk to them about how teeth are for food and explain it hurts the other child. 6 out of 6 staff stated they did not witness a staff leaving a child in the bathroom crying for 10 minutes.

Regarding allegations (3) Staff are not supervising day care children in the bathroom

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed staff not supervising day care children in the bathroom. Staff #3 (S3) stated, staff supervise the children as they use the restroom. Staff stand by the door to make sure they are safe. Staff #6 (S6) stated the children are free to use the restroom when they need. Staff ensure each child is supervised while the child is using the restroom.

Regarding allegations (4) Staff yelled at day care child

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed staff yell at day care child. Staff #2 (S2) stated, S2 has not witnessed staff yelling. At times, staff will use a firm voice, but not yelling to a child. Staff #3 (S3) stated some staff’ tones are louder than others; their tone but not yelling. Sometimes staff use a firm voice, because a child may hurt themselves or someone else, for safety reasons but never yelling.

Regarding allegations (5) Staff makes inappropriate comments towards day care children

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed staff make inappropriate comments towards day care children. Staff #3 (S3) stated, the facility does have a policy if a child has green boogers or mucus, staff call the director or assistant director and stated a child has green boogers. Staff have said a child has green boogers but staff do not call the child green boogers or any inappropriate comment towards them. Staff #6 (S6) stated, staff call the director to inform them that a child has mucus or green boggers. Green boogers is stated by staff on how they describe the mucus sometimes.


Regarding allegations (6) Staff did not ensure day care children listened to appropriate music

LPA interviewed 6 staff members, 6 out of 6 staff stated they have witnessed staff ensuring day care children listen to appropriate music. Staff #2 (S2) stated, staff play before and listen to it before staff play it for the children. Staff play radio music and classical music usually for nap time. Staff #3 (S3) stated, staff play kids bop or wee sing CD’s. Staff will google the lyrics before to make sure it is appropriate and kid friendly.

Regarding allegations (7) Staff did not ensure day care child ate

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed staff not ensuring day care child ate. Staff #1 (S1) stated, staff walk around lunch area. Staff verbally encourage children to eat. Staff don’t force them to eat but staff will encourage. Staff will communicate with parents on what the child ate and didn’t eat for the day. Sometimes staff will sit by the children to ensure they are eating. Staff #4 (S4) stated, staff set out their lunch out on the table for the children. Staff take any food out of wrappers and open containers, and staff encourage children to eat their main food.

Regarding allegations (8) Staff are not meeting day care child's needs

LPA interviewed 6 staff members, 6 out of 6 staff stated they have not witnessed staff not meeting day care child’s needs. Staff #1 (S1) stated, staff always help the children, staff are there to help and guide them, most children are too young to tie their shoes, so the staff will tie them for the children. Staff will help with wiping their nose, staff will remind them to get a tissue if staff see their nose is runny and remind them to wash their hands. Staff #4 (S4) stated, staff are always here to assist the children if they need help; that's the staff’s job and the reason staff are here, to help the children grow and develop.

On 10/29/24 LPA observed lunch time in the preschool classrooms. LPA observed staff wearing disposable gloves as they provided assistance to children as they opened food containers , opened food wrappers and verbally encouraged children to eat their meal. LPA observed staff sitting at children's table at eye level as they engaged in conversation with children, and encouraged children to eat.

LPA Duron interviewed 4 children. All 4 interviewed children did not reveal any staff violating their rights.

LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility.

Based on the information gathered from LPAs’ interviews, observation, and the record review, the preponderance of the evidence has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of Day care child sustained injury due to staff neglect, Staff used an inappropriate form of punishment for day care child, Staff are not supervising day care children in the bathroom, Staff yelled at day care child, Staff makes inappropriate comments towards day care children, Staff did not ensure day care children listened to appropriate music, Staff did not ensure day care child ate, and Staff are not meeting day care child's needs did or did not happen; therefore, the allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
