Licensing Program Analyst (LPA) Sun conducted an unannounced complaint inspection for the purpose of delivering complaint findings for the complaint investigation that was conducted by Investigations Branch (IB) Investigator Annette Renquist. Upon arrival, LPA met with Early Learning Specialist; Laura Barnett who guided LPA on a tour of the facility and LPA conducted a census. LPA observed 3 preschool staff caring for 12 children in the childcare area.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 07/21/2025 the Department received a complaint alleging Teacher allegedly touched child inappropriately. Reporting Party (RP) stated Child #1 (C1) had irritation on the anus and penis. C1 disclosed Staff #3 (S3) touched C1 inappropriately.

During the investigation, IB Investigator Renquist interviewed RP, 5 staff members, 1 child, 3 adults, reviewed medical record from CHOC, and reviewed Santa Ana Police Department (SAPD) report.

In the interview, RP stated on 7/14/25, Parent 1 (P1) discovered irritation on C1’s anus and penis while giving C1 a bath. On 7/17/25, C1’s penis and anus were still red so P1 asked C1 who touched C1 at school. C1 stated S3 touched C1’s anus with the finger. C1 did not tell P1 where in the classroom the touching occurred or if it happened while C1 was in the restroom. On 7/18/25, a complaint was filed with SAPD. There was no forensic interview conducted because C1 did not disclose C1 was touched inappropriately while at the police station.

During the interviews, Staff #3(S3), a teacher assistant, denied touching C1. S3 also denied ever taking C1 to the restroom, changing C1 if C1 was wet, or being alone with C1 in the classroom.

Staff #4 (S4) stated each classroom has 2 teachers and 1 teacher assistant. The teacher assistant is never alone with the children; never changes the students clothing; and never takes the child to the restrooms.

Staff #5 (S5) stated there are always two teachers and a teacher assistant in the classrooms. S5 also stated that at no time would the teacher assistant take a child to the restroom. It is in the facilities policy that only the teachers can do this and if the teacher’s assistant did, it would be violating their policy. S3 has never changed a child’s clothing, a diaper, or helped take a child to the restroom.

Staff #1 (S1) and staff #2 (S2) stated S3 did not take C1 nor any other children to the restroom. Both S1 and S2 claimed they are responsible for taking the children to the restroom. Both S1 and S2 stated S3 is not left alone in the classroom with the children. Both S1 and S2 stated they never saw S3 acting inappropriately with C1 or any other child.

On 9/23/25, LPA Sun and IB investigator Renquist attempted to interview C1; however, C1 was not qualified for an interview.

On 09/29/2025, IB requested a copy of medical records from Children’s Hospital of Orange County (CHOC) for C1 and IB Investigator received a certificate of no records from CHOC for C1

SAPD report indicated on 7/19/2025, the Sexual Assault Service Team (SART) conducted the SART exam for C1 and it was concluded “there were no findings of any sexual assault.”

Based on information gather from IB investigator’s interviews, medical report, and police report, the preponderance of evidence standard of Teacher allegedly touched child inappropriately has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegation is UNSUBSTANTIATED.


Exit interview was conducted with Early Learning Specialist, Laura Barnett. The Notice of Site Visit was posted. Licensee was informed that the Notice of Site Visit must be posted for 30 consecutive days. Licensee was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
