Complainant alleged that children are forced to sit at a table for 3 hours at a time. Complainant stated that because the facility has staffing issues the children are combined into one classroom. The children who are being added to the classroom are required to sit at the table and not allowed to move around in the classroom that they are combined in.
During the staff interviews, all 5 interviewed disclosed that the children in room 2 and room 4 are combined. Three out of the five staff interviews disclosed that children in room 4, when combined in room 2, are only allowed to do table activities and stayed at a small carpeted science area in room 2.
LPA Nguyen interviewed 6 preschool children, and all six children stated that room 4 children can only play at the table activities when combined in room 2.
During the physical plant inspection on 07/24/23, LPA observed room 4 combined in room 2 and room 4 children were doing table activities only.
Based on the information gathered from LPA's interviews with 5 staff members, 6 preschool children, and observation by LPA, it has been determined that staff limited the children to table top activities and the small carpeted science area for the extended periods of time when combined in room 2. The preponderance of evidence standard has been met; therefore, the above allegations are found to be SUBSTANTIATED. California Code of Regulations, Title 22 101223(a)(3) Personal Rights are being cited on the attached LIC9099D.
Exit interview was conducted with Director, Susan Bixler and Director of Preschool Program, Rochelle Nguyen. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. |
