Licensing Program Analysts (LPA) Aiddee Nunez conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 06/03/2024. Upon arrival LPA met with Administrator, Ranmal Jayasekara, to deliver complaint findings. Upon arrival census was taken in the classroom and observed a total of 18 preschool children napping and 1 staff member.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios.

On 05/28/24 the Orange County Child Care Office received a complaint alleging Staff handled children in a rough manner, Staff yelled at children, Staff spoke inappropriately to children, Staff left children in soiled diapers resulting in rashes, and Staff not maintaining facility free from outdoor hazards. Reporting Party (RP) stated Staff#1 (S1) would handle children in a rough manner, yell at them and say degrading things to them. RP stated S1 grabbed Child#1 (C1) and drag him by the shirt to the restroom and yelled at C1. RP stated S1 grab other children with force and sat them down for time out in a chair, make them cross their arms and then S1 would put S1 full body weight on their arms. RP stated S1 called children derogatory words. RP also stated S1 left the children in soiled diapers for long periods of time. RP stated that staff are supposed to change their diapers or pull-ups every 1-1.5 hours but S1 did not, and it resulted in children getting rashes. RP stated Staff#5 (S5) is building a shed in the play yard outside. RP stated there are hazards such as power tools and big pieces of plywood accessible to children even though he tried to block access by using yellow hazard tape.

During the investigation, LPA Nunez conducted a facility inspection of the outside playground, interviewed 4 staff members and the licensee, and tried to interview 2 children but they did not qualify for an interview, and obtain a copy of the children's roster and staff report.

On 8/1/2024, LPA obtain copies of the diaper changes logs dated from April until May of 2024.

On 6/3/2024 LPA interview 4 staff members including the administrator. 4 out 4 staff members stated they have not observed any staff members handle children in a rough manner. 4 out of 4 staff members stated they have not observed staff members yell at the children. 4 out of 4 staff members stated they have not heard staff members called children derogatory words. 2 out of 4 staff members mainly change the children’s diapers. 4 out 4 staff members stated they have not observed a staff member not changing a child’s diaper for long period of time. The 2 staff members stated diapers are checked every hour. The 2 staff members stated diaper changes are logged but diaper checks are not logged. The 2 staff members stated there was only one child, Child#2 (C2) with a diaper rash during the month of April and May. S1 stated that C2 came to the facility with a diaper rash. S2 also stated that C2 was the only child with a diaper rash during the months of April and May. LPA reviewed diaper changing records and S5 stated that S5 spoke to C2’s parent#1 (P1) and P1 stated that P1 took C2 to the doctor and the doctor stated he had a rash on C2’s bottom but it was not a diaper rash. S5 stated there were no children with diaper rashes during the month of

April and May of 2024. S5 stated that the shed was built a month and half ago and only worked on the shed during the weekends. S1 and S2 stated S5 worked on the shed during the week, Monday through Friday. S4 stated S5 worked on the shed while the children were napping. S1, S2, and S4 stated S5 did not worked on the shed when the children were present outside. 4 out of 4 staff members stated during the time the shed was being built the area was blocked with yellow tape and the children knew not to go to that area. S4 stated children do not play around the area where the shed is located. During the inspection dated 6/3/2024, LPA inspected the playground and observed the area where the shed was being built was blocked off with the yellow tape. LPA did not observe any hazardous items on the playground.

On 6/3/2024, LPA Nunez tried to interview 2 children, but the children did not qualify for an interview due to the children not being able to answer the qualification questions.

On 7/12/2024, LPA attempted to interview 8 parents however only 4 parents were available for interviews. The 4 parents were satisfied with the childcare center. LPA also spoke with C1’s Parent#2 (P2) and P2 stated they are very caring and are very happy with the school.


Based on LPA interviews conducted with 5 staff members, 4 parents, and records reviewed it was determined there was insufficient evidence that Staff handled children in a rough manner, Staff yelled at children, Staff spoke inappropriately to children, Staff left children in soiled diapers resulting in rashes, Staff not maintaining facility free from outdoor hazards. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview was conducted with Administrato, Ranmal Jayasekara. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
