On 08/15/2023, Licensing Program Analyst (LPA), Anna Chan conducted an onsite inspection for the purpose of an Annual Random Visit. LPA met with Director Cathy Sipia. LPA and Director toured the facility inside and outside and the floor and yard plan were verified. Census was taken. The overall census observed was 27 daycare children and 4 staff. The children are having circle time when LPA arrived at the facility.

During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. Facility hours are 6:30a.m.- 6:00p.m., Monday through Friday.

A review of the Facility Personnel Report Summary on 08/15/2023 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions, except for Victoria Majin (start date: 11/2021). LPA informed director staff above was not listed as associated to the facility on report summary. Staff Majin had her fingerprints taken on 07/08/2021. Upon further review of the staff personnel file and Guardian records, LPA showed Director the live scan request form was incomplete, therefore an eligible fingerprint clearance does not exist for staff Majin. A civil penalty is being assessed today.

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The Director let the staff leave and do the livescan immediately while LPA is in the facility. Director will send LPA a copy of livescan being done. Director will not let uncleared staff work in the facility until he/she is fingerprint cleared. Director will verify with licensing if staff is cleared to go back to work.

During the inspection of the indoor activity space, items which could pose a danger to children (detergents, cleaning compounds, and medications) were observed to be stored out of the reach of children. Age-appropriate materials such as books, puzzles, blocks, pretend play are provided. AM/PM snacks are provided by the facility, home lunch is brought by children from home. Snacks is prepared on site. Food prep areas were clean and sanitary. Food is properly stored. Menus were posted where they could be reviewed by parents. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. There is drinking water available to children indoors by purified water and sports bottle are also brought by children from home with the child’s name on it.

The children's bathrooms are clean and sanitary. Children nap in cots/mats and beddings and blankets are sent home weekly for washing. The facility has conducted an emergency drill on June 9, 2023. The facility has a working carbon monoxide detector and fire extinguisher. Facility met all posting requirement. The California Child Passenger Safety Law was posted by the entrance of the facility.

The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height. The surface of the outdoor activity space was well maintained and free of hazards. The cushioning material is wood chips and appeared to be enough to absorbs falls. There are slides, pretend kitchen, swing, and other climbing equipment around the playground. Purified drinking water in the outdoor activity space is provided and sports bottles with the child’s name on it. The outdoor equipment and toys were in good repair and free of sharp edges. There are no bodies of water present at the facility. The facility grounds were safe, sanitary and in good repair.

Staff files were reviewed for staff present during the facility inspection on this date, 5 staff files were reviewed. Health screening and immunization as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for the facility were reviewed and within compliance.

Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporter training, and to renew the training every two years. Based on LPA’s observation, record review, and interview, 3 staff members has expired Mandated Reporter training and is not in compliance of the above Health and Safety Code. None of the staff members present possesses current EMSA approved Pediatric CPR/First Aid certifications, which expired 07/2023.

6 Children's records were reviewed, and there was a separate, complete and current record for each child. In the areas reviewed the children’s files were found to be in full compliance. Sign in/out procedure was reviewed for compliance.

LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Based on LPA’s observation, record reviews and interview, a Type A violation was observed and is being cited in accordance with California Code of Regulations, Title 22, Division 12, Section 101170(e)(1) Criminal Background Clearance for one (1) staff not cleared to work at the facility. 2 Type B violation was also cited for violation of Health and Safety Code 1596.8662(b)(1) Administration of Child Day Care Licensing for expired Mandated Reporter Training for 3 staff, and Health and Safety Code Section 1596.866 Personnel Requirements for Not having current CPR/First Aid certifications, citations are on the attached LIC 809D.

Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Director Cathy Sipia

If the facility receives a Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day, and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00.
