On 10/02/2025, Licensing Program Analyst (LPA), Karen Navar conducted an unannounced complaint inspection for the purpose of delivering findings. This is a continuation of a complaint inspection initiated on 07/28/2025.

Upon arrival the LPA met with Director Sylvia Carrillo and was led on a tour of the facility both inside and outside. LPA observed a total of 42 preschool children along with 6 staff.

A review of the Facility Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios.

On 07/22/2025, the Orange County Child Care Office received a complaint alleging: 1) Staff violate children’s personal rights. 2) Staff do not supervise children in care. 3) Staff did not report injuries to authorized representatives. 4) Staff denied children access to the bathroom during nap time. Reporting Party (RP) stated that a child had been told that they could not go to the bathroom during nap time, that they were bad and will have to stand in a corner if they do not listen, and “You’re bad and you need to throw your toy away". RP stated that other children hit a child on the head while in care and staff did not know about it nor report the incident to the parents.

During the investigation, LPA toured the facility on 07/28/2025 and 08/25/2025 and conducted classroom observations, conducted 6 (six) staff (S1-S6) interviews and attempted 4 (four) children’s interviews but only 1 child qualified for an interview, obtained a copy of Kiddie Academy Personnel Roster, Kiddie Academy Classroom Schedule, Blank Rollcall Sheet for week 7/28/2025, Blank Accident/Injury Report, Child Care Facility Roster, reviewed Kiddie Academy Children Personal Rights Policy and Procedure signed by 5 (five) staff, and reviewed live video footage of classrooms and playground during visits.



During visits on 07/28/2025 and 08/25/2025, LPA conducted a facility tour and reviewed live video footage. During classroom observations LPA observed staff supporting children during bathroom time, engaging with children in activities, and supervising children on the playground. On 8/28/2025 LPA observed children napping/resting on cots and staff supporting children. During review of classroom/playground video footage, LPA observed staff supervising and supporting children.

Regarding allegations “Staff violate children’s personal rights”: 6 (six) of 6 (six) staff interviewed described the personal rights of a child means that you are not to deny children food, water, bathroom, sleep, and making sure that the children are safe, respected, and comfortable. 6 (six) of 6 (six) staff stated that they have not witnessed a staff telling a child that they were bad or a child to be threatened to stand in a the corner if they did not listen, and if they see a child experiencing challenges that need adult assistance they will support the child by redirecting them to something that they are interested in. 6 (six) of 6 (six) staff stated that they have not heard of any parent concerns regarding a child’s personal rights being violated. During records review LPA observed 5 (five) signed staff records with expectations pertaining to Kiddie Academies

Children Personal Rights Policy and Procedure. 2 (two) of 6 (six) interviewed staff stated they have heard of an incident regarding a child with a toy and being asked to throw it into the trash. 2 (two) interviewed staff stated it was a very small square type of toy and C1 had it in his mouth and when asked if it is trash to please throw it away. C1 had thrown it in the trash and did not indicate any emotion showing it was a personal item. 1 (one) interviewed staff stated there is a discloser for parents on daily schedule that is posted next to the classroom that states “Toys: No toys are allowed. This can be a distraction to the classroom and your child.” LPA verified posting of schedule next to classroom. 1 (one) interviewed staff stated they have spoken with parent regarding the incident.

Regarding allegation “Staff do not supervise children in care”: During staff interviews with 6 (six) staff, 6 (six) staff stated that they provide supervision to children in care by planning and engaging in activities with the children, supervising children by walking around so that they can see all the children, to be near the children so that they can help. Staff 6 (S6) stated that staff use a name to face format to count how many children are in care and provided LPA document Rollcall that S1 stated is used by staff. LPA observed Rollcall Sheet to have children’s name, days Monday-Friday, and week of date listed.

Regarding allegation “Staff did not report injuries to authorized representatives”: LPA interviewed 6 (six) staff who stated that they have not heard of a child being injured and it not being reported. 6 (six) of 6 (six) staff stated that when a child is injured, that they will assess the situation, provide first aid, inform the director, complete an incident report that staff and parents sign, and will evaluate the injury to see if a parent phone call is needed. S6 provided LPA with a copy of a blank Kiddie Academies Accident/Injury report and stated there are no reports for Child 1 (C1). S6 stated that there are pagers in the classrooms and playground for staff to use if they need assistance that will ring in the office and that staff will provide assistance if needed.

Regarding allegation “Staff denied children access to the bathroom during nap time”: During facility inspections on 07/28/2025 and 08/25/2025 LPA observed staff supporting children with bathroom needs. During LPA interviews, 6 (six) of 6 (six) staff stated that children may use the bathroom at nap time and that the children either wake up, raise their hand, or get up from their bed and ask the teacher and then use the bathroom. 6 (six) staff interviewed stated they have not seen a staff member deny a child to use the restroom during nap time.

LPA called 4 (four) parents to interview, LPA was not able to reach the parents and left a voicemail for parents to call back.

LPA attempted to interview 4 (four) children. 1 (one) of 4 (four) children attempted to be interviewed qualified to be interviewed and did not divulge any information regarding the allegations.

Based on LPA observations, interviews, and records review; the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations of; Staff violate children's Personal Rights. Staff do not supervise children in care. Staff did not report injuries to authorized representatives. Staff denied children access to the bathroom during naptime did not occur; therefore, the allegations are UNSUBSTANTIATED.

Exit interview conducted and report was reviewed with Director Sylvia Carrillo. The Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00.
