Reporting Party (RP) alleges (1) staff inappropriately disciplined child in care.
During the investigation, LPA interviewed staff and interviewed parents
Staff inappropriately discipline daycare children. According to the RP, their child stated that during nap time, the teacher spanked their bottom because they did not want to take a nap (no injuries to child). On 10/9/2024, LPA interviewed four staff. All staff interviewed stated they have never hit, pushed, grabbed or mishandled a child at the center or observed another staff doing so. Staff stated when a child does not want to sleep during nap time, the child is given a quiet activity.
On 10/15/2024, parent interviews were conducted. LPA contacted 14 parents via phone call. Out of 14 parents, four parents were able to be interviewed. Parents interviewed did not divulge and information pertaining to the allegation.
Children were not interviewed due to age and being Non-verbal.
Based LPA interviews with staff and parents, there was not enough evidence to substantiate the allegation.
The Orange County Child Care Office has investigated the complaint alleging (1) Staff inappropriately discipline daycare child: although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.

Notice of Site Visit was provided to the director. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The Director was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. |
